THE UTTAR PRADESH STATE LEGISLATURE (DELEGATION OF POWERS) ACT, 1995 [Act, No. 2 of 1996] [1st January, 1996] PREAMBLE An Act to confer on the President the power of the Legislature of the State of Uttar Pradesh to make laws. Be it enacted by Parliament in the Forty-sixth Year of the Republic of India as follows:--

Title: Conferment on the President of the Power of the State Legislature to Make Laws

.....whenever he considers it practicable to do so, consult a Committee constituted for the purpose, consisting of twenty members of the House of the People nominated by the Speaker and ten members of the Council of States nominated by the Chairman. (3) Every Act enacted by the President under sub-section (2) shall, as soon as may be after enactment, be laid before each House of Parliament. (4) Either House of Parliament may, by resolution passed within thirty days from the date on which the Act has been laid before it under sub-section (3), which period may be comprised in one session or in two successive sessions, direct any modifications to be made in the Act and if the modifications are agreed to by the other House of Parliament during the session in which the Act has been so laid before it or the session succeeding, such modifications shall be given effect to by the President by enacting an amending Act under sub-section (2): Provided that nothing in this sub-section shall affect the validity of the Act or of any action taken thereunder before it is so amended.

Savings The repeal by this Act of any enactment shall not affect any other enactment in which the repealed enactment has been applied, incorporated or referred to; d this Act shall not affect the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired, accrued or incurred, or any remedy or proceeding in respect thereof, or any release or discharge of or from any debt, penalty, obligation, liability, claim or demand, or any indemnity already granted, or the proof of any past act or thing; nor shall this Act affect any principle or rule of law, or established jurisdiction, form or course of pleading, practice or procedure, or existing usage, custom, privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed or recognised or derived by, in or from any enactment hereby repealed; nor shall me repeal by this Act of any enactment revive or restore any jurisdiction, office, custom, liability, right,.....

National Environment Tribunal Act, 1995 Chapter IV

Title: Jurisdiction and Proceedings of the Tribunal

.....under any award by the Tribunal on the ground of any damage to environment, that amount shall be remitted to the authority specified under sub-­section (3) of section 7A of the Public Liability Insurance Act, 1991 (6 of 1991) for being credited to the Environmental Relief Fund established under that section. (2) The amount of compensation credited to the Environmental Relief Fund under sub­-section (1) may be utilised by such person or authority, in such manner and for such purposes of environment as may be prescribed. Section 23 - Execution of award or order of Tribunal (1) An award made by the Tribunal under this Act shall be executable by the Tribunal as a decree of civil court, and for this purpose, the Tribunal shall have all the powers of a civil court. (2) Notwithstanding anything contained in sub-section (1), the Tribunal may transmit to the Collector having jurisdiction over the area in which the accident has occurred the copy of the order made by it for payment of relief as provided in the Public Liability Insurance Act, 1991 and the Collector shall execute the order in the same manner as if it were an order made by him under that Act. .....with the provisions of this Act: Provided that no such sanction shall be given unless at least two thirds of the members of the Board vote in favour of such transaction; (k) to administer the Wakf Fund; (l) to call for such returns, statistics, accounts and of her information from the mutawallis with respect to the wakf property as the Board may, from time to time, require; (m) to inspect, or cause inspection of, wakf properties, accounts, records or deeds and documents relating thereto; (n) to investigate and determine the nature and extent of wakf and wakf property, and to cause, whenever necessary, a survey of such wakf property; (o) generally do all such acts as may be necessary for the control, maintenance and administration of wakfs.
