GUJARAT STATE LEGISLATURE (DELEGATION OF POWERS) ACT, 1976 [Act, No. 44 of 1976] [30th March, 1976] PREAMBLE An Act to confer on the President the power of the Legislature of the State of Gujarat to make laws. BE it enacted by Parliament in the Twenty-seventh Year of the Republic of India as follows:-

Title: Conferment on the President of the Power of the State Legislature to Make Laws

.....considers it practicable to do so, consult a Committee constituted for the purpose, consisting of thirty-four members of the House of the People nominated by the Speaker and seventeen members of the Council of States nominated by the Chairman. (3) Every Act enacted by the President under sub-section (2) shall, as soon as may be after enactment, be laid before each House of Parliament. (4) Either House of Parliament may, by resolution passed within thirty days from the date on which the Act has' been laid before it under sub-section (3), which period may be comprised in one session or in two successive sessions, direct any modifications to be made in the Act and if the modifications are agreed to by the other House of Parliament during the session in which the Act has been so laid before it or the session succeeding, such modifications shall be given effect to by the President by enacting an amending Act under sub-section (2): PROVIDED that nothing in this sub-section shall affect the validity of the Act or of any action taken there under before it is so amended.

Savings The repeal by this Act of any enactment shall not affect any other enactment in which the repealed enactment has been applied, incorporated or referred to; and this Act shall not affect the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired, accrued or incurred, or any remedy or proceeding in respect thereof, or any release or discharge of or from any debt, penalty, obligation, liability, claim or demand, or any indemnity already granted, or the proof of any past act or thing; nor shall this Act affect any principle or rule or law, or established jurisdiction, form or course of pleading, practice or procedure, or existing usage, custom, privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed or recognised or derived by, in or from any enactment hereby repealed; nor shall the repeal by this Act of any enactment revive or restore any jurisdiction, office, custom, liability,.....

.....PowerTransmission Corporation] ''means the Karnataka 1 [PowerTransmission Corporation] constituted under section 5 of the Electricity(Supply) Act, 1948 (Central Act 54 of 1948); (2) ''dues'' means any sumpayable to the 1 [Karnataka Power Transmission Corporation] onaccount of,- (i) consumption of electricalenergy supplied ; or (ii) any remuneration, rent orother charges for hire, inspection, test, installation, connection, repairs,maintenance or removal of any electric meter, electric machinery, control gear,fittings, wires, or apparatus for lighting, heating, cooling or motive power orfor any other purpose for which electricity can or may be used, or anyindustrial or agricultural machinery operated by electricity ; or (iii) price of any such goods asaforesaid taken on loan but not returned ; 2 [Explanation.-Any sum payable to the Karnataka Electricity Board (hereinafter referred to asthe Board) under the Act, prior to the date of effective date of first transferof property, any interest in property or any rights and liabilities of theBoard to the Karnataka Power Transmission Corporation in accordance withsection 14 of the Karnataka Electricity Reforms Act, 1999,.....
