In this section "undertaking" means any public utility undertaking or any undertaking by way of any trade or business and includes a factory.] NOTES Object.--The Bombay Electricity (Special Powers) Act, 1946 was in force in the pre-Reorganisation State of Bombay, excluding the transferred territories. Similarly the Saurashtra Electricity (Special Powers) Act. 1953 (III of 1953) was in force in the Saurashtra area. But no such enactment existed in any other part of the State. It was therefore considered necessary for the sake of uniformity and administrative convenience to extend the provisions of the Bombay Electricity (Special Powers) Act, 1946, and to repeal the Saurashtra Electricity (Special Powers) Act, 1953. It was also proposed to amend sections 6A and 6B of the principal Act to enable Government to take action in respect of individual consumers for regulating supply and consumption of electrical energy to them and for discontinuing or reducing the supply in case of their default. It was further considered necessary to amend section 6A(l)(a) of the principal Act so as to empower Government to prohibit a consumer from supplying or allowing the use of.....

THE BOMBAY ELECTRICITY (SPECIAL POWERS) ACT, 19461 [Act No. 20 of 1946]2 [30th September, 1946] PREAMBLE An Act3[to make special provisions for controlling] the supply, consumption, distribution and use of electricity energy in the 4[State of Bombay.] WHEREAS it is expedient 3[to make special provisions for controlling] the supply, consumption, distribution and use of electrical energy in the 4[State of Bombay]; It is hereby enacted as follows : __________________________ 1. This Act was extended to that part of the State of Bombay to which" immediately before the commencement of Bom. 2 of 1959. it did not extend [vide Bom. 2 of 1959, Section 2). 2. .....energy to such extent and in such manner and by such means as may be specified in the order. The 1[State] Government shall serve a copy of the order on the licensee supplying the energy. IV-B, p. 946) In exercise of the powers conferred by sections 3, 4, 6A and 6B of the Bombay Electricity (Special Powers) Act. 1946 (Bom. XX of 1946), and all other powers enabling it in that behalf, the Government of Maharashtra hereby directs that - (a) the Maharashtra State Electricity Board shall, on a requisition made to it by a District Magistrate, discontinue or reduce, in the manner required by the District Magistrate, the supply of electrical energy to any consumer using or consuming the electrical energy for purposes of agriculture or irrigation: (b) the Maharashtra State Electricity Board shall discontinue forthwith supply of electrical energy to any consumer who contravene any order that may be made by the Board in pursuance of the clause (a) above. .....rendered by an Electric Inspector or any other officer appointed to assist the Electric Inspector under the provisions of the Indian Electricity Act, 1910, or any rules made thereunder within ten days from the date of the presentation of the bill for such inspection, examination, test or rendering of service, the 27 [State] Government or any other officer authorized by the 27 [State] Government in that behalf may, notwithstanding anything contained in the Indian Electricity Act, 1910., or the terms of any licence or sanction granted thereunder or any agreement for the supply of electrical energy, by order in writing direct the licensee, without prejudice to any other right to recover such fees, to discontinue the supply of electrical energy to such consumer and the licensee shall thereupon discontinue the supply of electrical energy to such consumer. (2) On payment of such fees by the consumer, the 26[State] Government or the authorized officer may by order in writing direct the licensee to reconnect and commence the supply of electrical energy, and the licensee shall thereupon connect and recommence the supply to consumer as soon as practicable: Provided that the licensee.....
