.....who, immediately before such vesting, has, in his possession, custody or control, any books, documents or other papers relating to the undertakings of Caltex (India) in India, shall be liable to account for the said books, documents and papers to the Central Government or the successor Government company, as the case may be, and shall deliver them up to the Central Government or that company or to such person as the Central Government or that company may authorise in this behalf. (2) Without prejudice to the other provisions contained in this section, it shall be lawful for the Central Government or the successor Government company to take all necessary steps for taking possession of all properties, which have been transferred to, and vested in, it under this Act.

THE KERALA DEBT RELIEF ACT, 1977 (ACT 17 OF 1977) [1] THE KERALA DEBT RELIEF ACT, 1977 (ACT 17 OF 1977) [1] An Act to provide relief from indebtedness to certain persons in the State of Kerala . Preamble. - WHEREAS it is expedient to provide relief from indebtedness to certain persons in the state of Kerala; BE it enacted in the Twenty-eighth Year of the Republic of India as follows: - 1. Short title, extent and commencement. - (1) This Act may be called the Kerala Debt Relief Act, 1977. (2) It extends to the whole of the State of Kerala . (3) It shall be deemed to have come into force on the 13 th day of January, 1977. 2. Definitions. - In this Act, unless the context otherwise requires, - (1) "appellate authority" means an appellate authority appointed under section 6; (2) "creditor" shall include the heirs, legal representatives and assigns of the creditor; (3) "debt" means any liability in cash or kind, whether secured or unsecured, due from or incurred by a debtor on or before the date of commencement of this Act, whether payable under a contract, or under a decree or order of any court, or otherwise, and subsisting on that date but does not include - any sum.....

.....took over the management of the company on the 31st March, 1971, under the provisions of Section 18A of the Industries (Development and Regulation) Act, 1951. The factory was reopened on the 12th April, 1971. The company is mainly engaged in the manufacture of rolling stock components of the Indian Railways, such as vacuum brake equipment, ejectors, steam valves, vacuum exhausters etc. After takeover of the management by the Central Government, there had been considerable progress in the production performance of the company. The actual production for the year 1976-77 had been of the order of Rs. 177 lakhs. After careful consideration of the whole matter, the Government decided to acquire the undertakings of this company. At the time of takeover of the management of the company, it was clear that it was not possible for the company to meet all its past dues. Accordingly, moratorium was imposed on the 14th August, 1972 in accordance with the provisions ofSec. 18FB of the Industries (Development and Regulation) Act, 1951, on realisation of the dues from the company. .....the Central Government as it might have been enforced by or against the Treasurer or the Board of Administration or such other person if this Act had not been enacted, and shall cease to be enforceable by or against the Treasurer or the Board of Administration or such other person.
