The Kerala Gift Goods (Unlawful Possession) Act, 1963 Complete Act

.....or is proved to have been, in possession of any gift goods reasonably suspected of being stolen or unlawfully obtained and cannot account satisfactorily how he came by the same, he shall be punished with imprisonment for a term which may extend to two years or with fine, or with both. Section 4 - Offences under the Act to be cognizable (1) Notwithstanding anything contained in the Code of Criminal Procedure, 1898 (Central Act 5 of 1898) any offence under this Act shall be deemed to be a cognizable offence within the meaning of that Code. (2) No court below that of a Magistrate of the First Class shall try any offence under this Act. Section 5 - Power to amend Schedules [Pub. in K.G. Ex. No. 11 dated 11-1-1963)] [(1) The Government may, by notification in the Gazette, amend Schedule I by adding the name of any goods in, or omitting the name of any goods from, the said Schedule and thereupon that Schedule shall be deemed to be amended accordingly. (2) The Government by notification in the Gazette, amend Schedule II by adding the name of any organization in, or omitting the name of any organization from, the said Schedule and thereupon that Schedule shall be deemed.....

THE SUITS FOR POSSESSION AND INJUNCTION (RE-TRANSFER) ACT, 1963 ACT 9 OF 1963[1] THE SUITS FOR POSSESSION AND INJUNCTION (RE-TRANSFER) ACT, 1963 An Act to make provision for the re-transfer of certain suits transferred to the Revenue Divisional Officers in pursuance of section 6-A of the Madras Cultivating Tenants Protection Act, 1955. Preamble.-WHEREAS it is expedient to make provision for the re-transfer of certain suits transferred to the Revenue Divisional Officers in pursuance of section 6A of the Madras Cultivating Tenants Protection Act, 1955 (which has ceased to be in force), to the Courts which transferred the suits; BE it enacted in the Thirteenth Year of the Republic of India as follows:- 1.Short title."This Act may be called the Suits for Possession and Injunction (Re-transfer) Act, 1963. 2.Re-transfer of certain suits for possession of, or injunction in relation to, land.-If any suit transferred to the Revenue Divisional Officer by any Court in pursuance of section 6A of the Madras Cultivating Tenants Protection Act, 1955 (Madras Act XXV of 1955), was pending with the Revenue Divisional Officer on the 27 th day of September, 1958, on which date the said.....

Section 8 - Liability of person in possession, not as owner, to deliver to persons entitled to immediate possession Any person having the possession or control of a particular article of movable property, of which he is not the owner, may be compelled specifically to deliver it to the person entitled to its immediate possession, in any of the following cases.-- (a) when the thing claimed is held by the defendant as the agent or trustee of the plaintiff; (b) when compensation in money would not afford the plaintiff adequate relief for the loss of the thing claimed; (c) when it would be extremely difficult to ascertain the actual damage caused by its loss; (d) when the possession in the thing claimed has been wrongfully transferred from the plaintiff. Explanation.--Unless and until the contrary is proved, the court shall, in respect of any article of movable property claimed under clause (b) or clause (c) of this section, presume-- (a) that compensation in money would not afford the plaintiff adequate relief.....

.....information that the possession of any property suspected to have been transferred by any offence mentioned in section 410 of the Indian Penal Code or by any offence punishable under sections 417, 418, 419 or 420 of the said Code, is found in possession or thereafter comes into the possession or has an offer either by way of sale, pawn, exchange or for custody, alteration or otherwise, howsoever made to him of property answering the description contained in such information shall, unless,-- (i) he forthwith gives information to the Commissioner or the Superintendent, as the case may be, or at a Police Station, of such possession or offer and takes all reasonable means to ascertain, and to give information as aforesaid of the name and address of the person from whom the possession or offer was received, or (ii) the property being, as an article of common wearing apparel or otherwise, incapable of identification from the written or printed information given, has in no way concealed after the receipt of such information, on conviction, be punished with fine which may extend to fifty rupees in respect of each such article of property so in his possession or offered to.....

Section 27 - Extinguishment of right to property At the determination of the period hereby limited to any person for instituting a suit for possession of any property, his right to such property shall be extinguished.

Specific Relief Act 1963 Section 22

Title: Power to Grant Relief for Possession, Partition, Refund of Earnest Money, Etc

(1) Notwithstanding anything to the contrary contained in the Code of Civil Procedure,1908, any person suing for the specific performance of a contract for the transfer of immovable property may, in an appropriate case, ask for-- (a) possession, or partition and separate possession, of the property, in addition to such performance; or (b) any other relief to which he may be entitled, including the refund of any earnest money or deposit paid or2[made by] him, in case his claim for specific performance is refused. (2) No relief under clause (a) or clause (b) of sub-section (1) shall be granted by the court unless it has been specifically claimed: Provident that where the plaintiff has not claimed any such relief in the plaint, the court shall, at any stage of the proceeding, allow him to amend the plaint on such terms as may be just for including a claim for such relief. (3) The power of the court to grant relief under clause (b) of sub-section (1) shall be without prejudice to its powers to award compensation under section 21. ______________________ 2. Title: Possession of Property of Which No Satisfactory Account Can Be Given

Whoever has in his possession or conveys in any manner, or offers for sale or pawn, anything which there is reason to believe is stolen property, or property fraudulently obtained, shall, if he fails to account for such possession or act to the satisfaction of the Magistrate, on conviction, be punished with imprisonment for a term which may extend to three months or with fine which may extend to one hundred rupees or with both.
