Registration Act, 1908 Section 38

Title: Persons Exempt from Appearance at Registration-office

(1) (a) A person who by reason of bodily infirmity is unable without risk or serious inconvenience to appear at the registration-office, or (b) a person in jail under civil or criminal process, or (c) person exempt by law from personal appearance in Court, and who would but for the provisions next hereinafter contained be required to appear in person at the registration-office, shall not be required so to appear. (2) In the case of every such person the registering officer shall either himself go to the house of such person, or to the jail in which he is confined, and examine him or issue a commission for his examination.

Displaced Persons Compensation and Rehabilitation Act 1954 [Repealed] Chapter II

Title: Payment of Compensation and Rehabilitation Grants to Displaced Persons

.....to the displaced person is payable in the form of transfer of any property from the compensation pool, then subject to a prior charge under sub-section (3) of section 20, to a second charge on such property for the amount which would have been payable to the banking company under clause (a) if the displaced person had been paid compensation in cash; (c) if the compensation to the displaced person is payable in any other form, to such relief as the Settlement Officer, having regard to the principle specified in clause (a) or clause (b), may determine. (3) For the purposes of this section,-- (a) the expression 'banking company' means any of the displaced banks specified in the Schedule and includes any other banking company which, before the fifteenth day of August, 1947 carried on the business of banking, whether wholly or partially in any area now forming part of West Pakistan, and which the Central Government may, having regard to the dislocation of such business on account of the partition of the country, by notification in the Official Gazette, specify in this behalf; (b) the expression 'total debt' means,-- (i) where the banking company has preferred a claim.....

BE it enacted by Parliament in the Nineteenth Year of the Republic of India as follows : - 1. Short title This Act may be called the Displaced Persons (Compensation and Rehabilitation) Amendment Act, 1968. 2. Insertion of new section 8A In the Displaced Persons (Compensation and Rehabilitation) Act, 1954 (44 of 1954) , after section 8, the following section shall be, and shall be deemed always to have been, inserted, namely :-- "8A.Payment compensation in cases of mortgaged properties.- (1) Where any compensation is payable to any displaced persons in lieu of property abandoned by him in West Pakistan which on the date of his migration from West Pakistan was subject to a mortgage in favour of a person who is not resident in India, the Settlement Commissioner shall, after giving a reasonable notice to the displaced person, determine the principal sum for which the property was so mortgaged and such portion of the principal sum so determined as bears the same proportion as the compensation payable to the.....

THE REMITTANCES OF FOREIGN EXCHANGE AND INVESTMENT IN FOREIGN EXCHANGE BONDS (IMMUNITIES AND EXEMPTIONS) ACT, 1991 [Act No. 41 of 1991] Preamble An Act to provide for certain immunities to persons receiving remittances in foreign exchange and to persons owning the Foreign Exchange Bonds and for certain exemptions from direct taxes in relation to such remittances and bonds and for matters connected therewith or incidental thereto. WHEREAS the position relating to balance of payments has become difficult and it is necessary to attract large inflow of foreign exchange. and WHEREAS with a view to attracting such inflow of foreign exchange, it is expedient to provide for certain immunities and exemptions to render it possible for certain persons to receive the said remittances in foreign exchange and to own the said Bonds. be it enacted by Parliament in the Forty-second Year of the Republic of India as follows:--

Section 3 - Power of State Government to exempt any race, sect or tribe in the State from operation of Act ( 1) The State Government may, by notification in the Official Gazette, either retrospectively from the sixteenth day of March, 1865, or prospectively, exempt from the operation of any of the following provisions of this Act, namely, sections 5 to 49 , 58 to 191 , 212, 213 and 215 to 369 , the members of any race, sect or tribe in the State, or of any part of such race, sect or tribe to whom the State Government considers it impossible or inexpedient to apply such provisions or any of them mentioned in the order. ( 2) The State Government may, by a like notification, revoke any such ord er, but not so that the revocation sh all have retrospective effect. ( 3) Persons exempted under this section or exempted from the operation of any of the provisions of the Indian Succession Act, 18651(10 of 1865), under section 332 of that Act are in this Act referred to as "exempted persons". _____________________ 1. THE VOLUNTARY DEPOSITS (IMMUNITIES AND EXEMPTIONS) ACT, 1991 [Act, No. 47 of 1991] PREAMBLE An Act to provide for certain immunities to persons making voluntary deposits with the National Housing Bank and for certain exemptions from direct taxes in relation to such deposits and for matters connected therewith or incidental thereto. Whereas for effective economic and social planning it is necessary to canalise for certain social objectives black money which has become a serious threat to the national economy. And whereas with a view to such canalisation, the Central Government has decided to allow voluntary deposits being made with the National Housing Bank in accordance with a scheme to be formulated by that Bank whereunder forty per cent of the amount of such deposits will be credited to a special fund to be created for financing slum clearance and low cost housing for the poor and sixty per cent of the amount of such deposits can be utilised by the depositors for purposes specified by them. AND whereas it is expedient to provide for certain immunities and exemptions to render it possible for persons in possession of black money to make such deposits. Be it.....
