.....relevant notification specified in section 10 of this Act, but does not include--". 3. Amendment of section 11 In section 11 of the principal Act, sub-section (2) shall be omitted. 4. Amendment of section 19 In section 19 of the principal Act, for sub-section (2), the following sub-section, shall be substituted, namely:-- "(2) Where any person,-- (a) has ceased to entitled to the possession of any evacuee property by reason of any action taken under sub-section (1), or (b) is otherwise in unauthorised possession of any evacuee property or any other immovable property forming part of the compensation pool; he shall, after he has been given a reasonable opportunity of showing cause against his eviction from such property, surrender possession of the property on demand being made in this behalf by the managing officer or managing corporation or by any other person duly authorised by such officer or corporation.". 5. Amendment of section 20 In section 20 of the principal Act, in clause (d) of sub-section (1) after the words "to a displaced person", the following words shall be inserted, namely:-- "or any association of displaced persons, whether incorporated.....

Title: Compensation Pool for Purposes of Payment of Compensation and Rehabilitation Grants to Displaced Persons

.....property or part thereof being in occupation of a displaced person or otherwise, then, notwithstanding anything contained in the Evacuee Property Act and this Act, it shall be lawful for the Central Government-- (a) to transfer to the applicant in lieu of the evacuee property or any part thereof, any immovable property in the compensation pool or any part thereof, being in the opinion of the Central Government as nearly as may be of the same value as the evacuee property or, as the case may be, any part thereof, or (b) to pay to the applicant such amount in cash from the compensation pool in lieu of the evacuee property or part thereof, as the Central Government having regard to the value of the evacuee property or part thereof, may in the circumstances deem fit. Explanation. -The provisions of this sub- section shall apply, whether or not, a certificate for the restoration of the evacuee property has been issued to the applicant under sub- section (1) of section 16 of the Evacuee Property Act, as in force immediately before the commencement of the Administration of Evacuee Property (Amendment) Act, 1956, if the evacuee property has not in fact been restored to the.....

THE AMBERNATH INTERIM MUNICIPALITY (CONSTITUTION AND ACTIONS) VALIDATION ACT, 1965 [Act No. 49 of 1965]1 [14th December, 1965] PREAMBLE An Act to validate the constitution of an interim municipality for Ambernath municipal district and to make certain consequential provisions upon conversion of village panchayat into a municipality. WHEREAS, by Government Notification, Local Self-Government and Public Health Department, No. DTM. 2553/A, dated the 6th May, 1959, issued under section 4 of the Bombay District Municipal Act, 1901 (Bom. III of 1901), the State Government declared the local area specified therein which was within the limits of certain village to be a permanent municipal district with effect from the 11th May, 1959 under the name of the municipal district of Ambernath; AND WHEREAS, relying on section 191-B of the said District Municipal Act as it stood before its amendment by Bombay Act VIII of 1959 (which came into force on the 13th March, 1959), the persons vacating office as members of the village panchayat constituted an interim municipality for the newly created municipal district with effect from the 11th May, 1959, with the Sarpanch and Deputy.....

Title: Validation of Certain Action Taken Before the Commencement of the Act

Anything done or any action taken (including any order made) by the Chief Settlement Commissioner, Settlement Commissioners, Additional Settlement Commissioners or Settlement Officers for the purposes of payment of compensation or rehabilitation grants or other grants to displaced persons shall, in so far as it is not inconsistent with the provisions of this Act, be deemed to have been done or taken in the exercise of the powers conferred by or under this Act as if this Act were in force on the date on which such thing was done or action was taken.

Title: Payment of Compensation and Rehabilitation Grants to Displaced Persons

.....to the displaced person is payable in the form of transfer of any property from the compensation pool, then subject to a prior charge under sub-section (3) of section 20, to a second charge on such property for the amount which would have been payable to the banking company under clause (a) if the displaced person had been paid compensation in cash; (c) if the compensation to the displaced person is payable in any other form, to such relief as the Settlement Officer, having regard to the principle specified in clause (a) or clause (b), may determine. .....Code (45 of 1860) and the Chief Commissioner, the Commissioner, the competent authority, shall be deemed to be a civil court for the purposes of section 195 and Chapter XXVI of the Code of Criminal Procedure, 1973 (2 of 1974). Section 64 - Annual report to be prepared by the Chief Commissioner (1) The Chief Commissioner shall prepare in such form and at such time for each financial year as may be prescribed by the Central Government an annual report giving a full account of his activities during the previous financial year and forward a copy thereof to the Central Government. (2) The Central Government shall cause the annual report to be laid before each House of Parliament along with the recommendations explaining the action taken or proposed to be taken on the recommendation made therein insofar as they relate to the Central Government and the reasons for non-acceptance, if any, of any such recommendation or part. No suit, prosecution or other legal proceeding shall lie against the Central Government or the Trust or any member of the Board or Chief Executive Officer or any officer or other employee of the Trust or any other person authorised by the Board to perform duties under this act for any loss or damage caused or likely to be caused by anything which is done in good faith. Explanation:--For the purposes of this section, the expression "good faith" shall have the same meaning as is assigned to it in the Indian Penal Code (45 of 1860).
