THE MUMBAI MUNICIPAL CORPORATION ACT 1888 THE MUMBAI MUNICIPAL CORPORATION ACT 1888 An Act to consolidate and amend the law relating to the Municipal Government of '[Brihan Mumbai]. Preamble. WHEREAS it is expedient to consolidate and amend the law relating to the Municipal Government of '[Brihan Mumbai]; It is enacted as follows: CHAPTER I PRELIMINARY SECTION 01: SHORT TITLE AND EXTENT This Act may be cited as 2 [the Mumbai Municipal Corporation Act, 1888] 3 [It] extends only to 1 [Brihan Mumbai]. SECTION 02: REPEAL OF ENACTMENTS The enactments mentioned in Schedule A are repealed to the extent specified in the third column of the said Schedule: Provided that- (a) all rules and by-laws made, all notifications published, all orders issued and all I licenses and permissions granted under any of the said enactments and still in force shall, so far as they are consistent with this Act, be deemed to have been respectively made, published, issued and granted hereunder; and (b) all debts and obligations incurred, all contracts entered into and all matters and things engaged to be done, by, with or for the municipal corporation before this Act comes into force shall be.....

Title: Procedure with Regard to Pauper Lepers

.....that the person is a leper,and may for this purpose adjourn the enquiry form time to time, remanding theperson for observation or for other reason to such place as may be convenient,or admitting him to bail ; Providedalso that if any friend or relative of any person found to be a pauper lepershall undertake in writing to the satisfaction of the Magistrate that suchpauper leper shall be properly taken care of and shall be prevented frompublicly begging in any area specified under section 3, the Magistrate, insteadof sending the leper to any asylum, may make the leper over to the car of suchfriend or relative, requiring him, if he thinks fit, to enter into a bond withone or more sureties, to which the provisions of section 514 of the code ofcriminal Procedure (10 of 1882.) {See now the Code of Criminal Procedure,1898 (5 of 1898).} shall be applicable. (2)If the Magistrate finds that such person is not a leper, or that, if a leper, heis not a pauper leper, he shall forthwith discharge him.

Title: Exclusion of Time in Cases Where Leave to Sue or Appeal as a Pauper is Applied for

In computing the period of limitation prescribed for any suit or appeal in any case where an application for leave to sue or appeal as a pauper has been made and rejected, the time during which the applicant has been prosecuting in good faith his application for such leave shall be excluded, and the court may, on payment of the court fees prescribed for such suit or appeal, treat the suit or appeal as having the same force and effect as if the court fees had been paid in the first instance.

Colonial Prisoners Removal Act, 1884 [Repealed] Section 10

Title: Application of Act to Removal of Criminal Lunatics

.....to criminal lunatics and (subject to those regulations) all laws and regulations in force in the part of Her Majestys dominions in which a criminal Judaic removed or returned is for the time being in custody under a warrant issued in pursuance of this Act, shall apply to such criminal lunatics as if he had become a criminal lunatic in that part. (2) Where a person, who is a criminal lunatic by reason of being unfit to be tried for an offence, is removed in pursuance of this Act, and a Secretary of State or the Governor of the British possession to or from which such person was removed considers that such person has become sufficiently sane to be tried for the said offence and requires him to be returned for trial to the British possession from which he was removed, he shall, in accordance with the regulations under this Act he returned as a prisoner to the said British possession for the purpose of being there tried for the said offence, and shall he removed thither in custody in like manner as if he had been arrested under a warrant on a charge for the said offence.

Title: Arrest of Pauper Lepers

(1) Within any local area which has been specified under section 3 any police-officer {Ins. by section 5.ibid.[ or any other person specially empowered by the State Government by order in writing in this behalf] may arrest without a warrant any person who appears to him to be a pauper leper. Colonial Prisoners Removal Act, 1884 [Repealed] Section 17

Title: Application of Act to Existing and Criminal Lunatics

This Act shall apply to a prisoner who has been convicted, and to a criminal lunatic who has become a criminal lunatic before the passing of this Act. in like manner as if he had been convicted and became a criminal lunatic after the commencement of this Act.
