THE KERALA ADVOCATES' CLERKS WELFARE FUND ACT, 2003 [1] ACT 27 OF 2003 THE KERALA ADVOCATES' CLERKS WELFARE FUND ACT, 2003 [1] An Act to provide for the constitution of a Welfare Fund for the Benefit of Advocates' Clerks in the State of Kerala and for matters connected therewith or incidental thereto . Preamble.--WHEREAS it is expedient to provide for the constitution of a Welfare Fund for payment of retirement and other benefits to Advocates' Clerks in the State of Kerala and for matters connected therewith or incidental thereto; BE it enacted in the Fifty-fourth year of the Republic of India as follows:- 1. Short title and commencement.--(1) This Act may be called the Kerala Advocates' Clerks Welfare Fund Act, 2003. (2) It shall come into force on such date as the Government may, by notification in the Gazette, appoint. 2. THE ORISSA ADVOCATES' CLERKS WELFARE FUND ACT, 2008 THE ORISSA ADVOCATES' CLERKS WELFARE FUND ACT, 2008 [Act 5 No. of 2009] PREAMBLE An Act to Provide for the Constitution of a Welfare Fund and Utilisation Thereof for Promotion of Welfare of the Advocates' Clerks in the State of Orissa and for Matters Connected therewith or Incidental thereto. BE it enacted by the Legislature of the State of Orissa in the Fifty-ninth Year of the Republic of India as follows:" Section 1 - Short title, extent and commencement (1) This Act may be called the Orissa Advocates' Clerks Welfare Fund Act, 2008. (2) It extends to the whole of the State of Orissa. (3) It shall come into force on such date as the State Government may, by notification, appoint in this behalf. .....(2).It shall be deemed to have come into force on the 10th day of June, 2008. 2. Amendment of section 14.-In the Kerala Advocates' Clerks Welfare Fund Act, 2003 (27 of 2003) (hereinafter referred to as the principal Act), in sub-section (1) of section 14 , for the words, "of the value of two rupees" the words, "of the value of six rupees" shall be substituted. 3.Amendment of section 17.-In the principal Act, in sub-section (5) of section 17 , for the words, ˜two hundred rupees" the words, "four hundred rupees" shall be substituted. 4. Repeal and saving.-(1) The Kerala Advocates' Clerks Welfare Fund (Amendment) Ordinance,2008 (34 of 2008) is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act as amended by this Act. Title: Criminal Breach of Trust by Clerk or Servant

Title: Registered Clerks Welfare Fund

(1) Subject to such rules as may be prescribed by it, the State Government shall constitute a fund called the Karnataka Registered Clerks' Welfare Fund for payment of retirement benefits to the registered clerks in the State. (2) There shall be credited to the Fund,-- (a) any grant that may be made by the State Government; and (b) any donation or contribution made to the Fund by the Bar Council of India, Bar Council, any Bar Association, any association or authority, institution, any advocate or any other person. (3) The State Government shall constitute a committee for the administration of the Fund. (4) The State Government may make rules to provide for all matters relating to the Fund including its membership and administration and the conditions subject to which payment from the Fund shall be made.

Title: Special Provisions in Relation to Articled Clerks

.....commenced his articleship and passed the Preliminary examination, for the purpose of enrolment as an attorney of the High Court at Calcutta in accordance with the rules made under sub-section (2) of Section 34 before the omission of that sub-section by the Advocates (Amendment) Act 1976, (107 of 1976), may be admitted as an advocate on the State roll if he- (i) passes, on or before the 31stday of December, 1980- (a) the Final examination in a case where such person has before the 31stday of December, 1976, passed the Intermediate examination. (b) the Intermediate and the Final examinations in any other case. Explanation.- For the purpose of this clause, the High Court at Calcutta may prescribe such rules as may be necessary under sub-section (2) of Section 34, specifying the nature of the examination and any other matter relating thereto: (ii) makes an application for such enrolment in accordance with the provisions of this Act; and (iii) fulfills the conditions specified in clauses (a), (b), (e) and (f) of sub-section (1) of Section 24 ]. ________________________ 1.
