.....enacted by Parliament as follows :- SECTION 01: SHORT TITLE This Act may be called the Indian Independence Pakistan Courts (Pending Proceedings) Act, 1952. SECTION 02: DEFINITION - In this Act, the expression "decree to which this Act applies "means any such judgment, decree or order as referred to in - (i) clause (3) of Article 4 of the Indian Independence (Legal Proceedings) Order, 1947, or (ii) paragraph (5) or paragraph (6) of Article 13 of the High Courts (Bengal) Order, 1947, or (iii) paragraph (4) or paragraph (6)1[of Article 13] of the High Courts (Punjab) Order, 1947, which has been or may hereafter be passed by a Court in Pakistan and which imposes any liability or obligation on a Government in India. SECTION 03: CERTAIN PAKISTAN DECREES NOT TO BE GIVEN EFFECT TO IN INDIA Notwithstanding anything contained in any of the Orders referred to insection 2-, no decree to which this Act applies shall be given effect to by any Court or authority in India in so far as such decree imposes any liability or obligation on any Government in India. SECTION 04: RIGHT OF HOLDER OF A DECREE TO WHICH THIS ACT APPLIES TO INSTITUTE FRESH PROCEEDINGS IN INDIA Notwithstanding anything.....

Influx from Pakistan (Control) Repealing Act, 1952 Complete Act

.....State Government; (c) 'permit' means a permit issued or renewed or the period whereof has been extended in accordance with the rules made under this Act. SECTION 05: CONTROL OF ADMISSION INTO INDIA OF PERSONS FROM PAKISTAN No person shall enter India from any place in Pakistan, whether directly or indirectly, unless- (a) he is in possession of a permit; or (b) being a person not domiciled in India or Pakistan, he is in possession of a valid passport as required by theIndian Passport Act, 1920-, or (c) he is exempted from the requirement of being in possession of a permit by or in accordance with the rules made under this Act. SECTION 06: PUNISHMENT OF OFFENCES (1) Whoever enters India in contravention of the provisions ofsection 3-, or having entered India contravenes the provisions of any rule made undersection 4-, or commits a breach of any of the conditions of his permit, shall be punishable with imprisonment for a term which may extend to one year, or with fine which may extend to one thousand rupees, or with both. .....Pakistan nationals in India is regulated by the system of residential permits in accordance with the Indo-Pak Visa Scheme of 1974 and system of pennils introduced by the provisions of the Influx from Pakistan (Control) Act, 1949 has lapsed since long. Hence, the Influx from Pakistan (Control) Repealing Act, 1952 has no relevance and needs to be repealed. 2.The Bill seeks to achieve the above object. SECTION 01: SHORT TITLE. 1[13. Transfer of property to Pakistan.-- (1) Notwithstanding anything contained in this Act, the Managing Body may, from out of the funds specified in column 1 of the Third Schedule, transfer to the Pakistan Red Cross Society the amounts specified in that Schedule as being the share of the Pakistan Red Cross Society which that Society has agreed to receive for being applied to the purposes for which they were held by the Society. (2) Upon the transfer of such amounts to the Pakistan Red Cross Society under sub-section (1), the Society shall be freed and discharged from all obligations imposed upon it by or under this Act as in force before the commencement of the Indian Red Cross Society (Amendment) Act, 1956, or under any trust or other document in respect of anything to be done in Pakistan or in any part thereof.] _____________________________ 1. Transfer of Evacuee Deposits Act, 1954 [Repealed] Section 5

Title: Procedure for Transfer of Certain Other Deposits to Pakistan

.....inspect the same. (2) If after making any such inspection as is referred to in sub-section (1) and after making such further inquiry into the matter as may be prescribed, the Custodian is satisfied that the deposit is a transferable deposit within the meaning of this Act, he may by order, direct that the deposit shall be transferred to such authorised officer or authority in Pakistan as the Central Government may, by general or special order, specify in this behalf, and any court or other authority holding in its custody or under its control any such deposit shall comply with the direction. (3) Notwithstanding anything contained in this section, where in respect of any deposit the extent of the right or interest of an evacuee in such deposit is not easily ascertainable or, having regard to the nature of the deposit, it is in the opinion of the Custodian not practicable to separate the right or interest of the evacuee from the right or interest of other persons in such deposit, the Custodian shall not transfer any part of the deposit to Pakistan.

Title: Reception in India of Deposits Transferred from Pakistan

(3) The court to which a deposit and any record relating thereto are forwarded under sub-section (2) shall proceed to deal with the matter as if the deposit had been made in compliance with an order made by it in a proceeding before it and, after making such further inquiry into the matter as it thinks fit, award the deposit to or distribute it among the person or persons who in its opinion is or are entitled thereto. (4) An appeal shall lie from every order passed by any court under sub-section (3) to the court authorised to hear appeals from the decisions of such court if the amount or value of the subject matter of the claim made in the appeal exceeds two thousands rupees. (5) The disposal of any deposit in accordance with the provisions of this section shall discharge the Custodian from any liability to any person in respect of the deposit.

Constitution of India Article 7

Title: Rights of Citizenship of Certain Migrants to Pakistan

Notwithstanding anything in articles 5 and 6, a person who has after the first day of March, 1947, migrated from the territory of India to the territory now included in Pakistan shall not be deemed to be a citizen of India: Provided that nothing in this article shall apply to a person who, after having so migrated to the territory now included in Pakistan, has returned to the territory of India under a permit for resettlement or permanent return issued by or under the authority of any law and every such person shall for the purposes of clause (b) of article 6 be deemed to have migrated to the territory of India after the nineteenth day of July, 1948.

Endorsement Of Certificates And Licences Granted In Pakistan Any certificate or licence granted by the Government 2 [of Bangladesh] in accordance with the provisions of any law for the time being in force in 3 [that country] corresponding to the provisions of Chapter II or Chapter III of this Act may, on payment of the fees prescribed for the grant of a similar certificate or licence under this Act, be endorsed by-- (a) the Government of any State in India, or (b) with the general or special sanction of the Government of such State, by any authority competent to grant a similar certificate or licence under this Act. and upon any such certificate or licence being so endorsed, it shall have effect as if it had been granted under this Act]. ________________________ 1.
