In the principal Act, after section 88, the following sections shall be inserted, namely: Definitions. 88A. In this Part, unless the context otherwise requires, (a) Declaration of Maritime Labour Compliance means a declaration issued by the Director-General of Shipping or by any officer, authority or organisation authorised by him in this behalf, in respect of a ship that it meets with the requirements and standards set out in the provisions of the Maritime Labour Convention; (b) "Maritime Labour Certificate" means the certificate issued by the Director-General of Shipping or by any officer, authority or organization authorised by him in this behalf, in accordance with the provisions of the Maritime Labour Convention; (c) "Maritime Labour Convention" means the International Convention of Maritime Labour Organisation on Maritime Labour Standards signed in Geneva on the 23rd February, 2006; (d) "seafarer" means any person who is employed or engaged or works in any capacity on board a sea going ship, but does not include (i) the employment or engagement.....

The Merchant Shipping (Amendment) Act, 2014 Complete Act

.....sub-section (1) in respect of such ship as a copy of the records of the ship to be a true copy and such copy shall be admissible as evidence of the facts stated therein. Information regarding contravention of the provisions of Convention 356X. (1) If, on receipt of a report from a surveyor or other person authorised to inspect a ship, the Director-General is satisfied that any provision of this Part has been contravened by such ship within the coastal waters, the Director-General or any officer authorised by him in this behalf, may (a) detain the ship until the causes of such contravention are removed to the satisfaction of the Director-General or the officer authorised by him; and (b) levy penalty on such ship as specified in section 436: Provided that where the Director-General deems it necessary, he may request the Indian Navy or the Coast Guard for preventing the ship from proceeding to sea and the Indian Navy or the Coast Guard, as the case may be, shall take action as requested by the Director-General. Title: Return of Unutilised Land

When any land acquired under this Act remains unutilised for a period of five years from the date of taking over the possession, the same shall be returned to the original owner or owners or their legal heirs, as the case may be, or to the Land Bank of the appropriate Government by reversion in the manner as may be prescribed by the appropriate Government. Explanation.--For the purpose of this section, "Land Bank" means a governmental entity that focuses on the conversion of Government owned vacant, abandoned, unutilised acquired lands and tax-delinquent properties into productive use.

Title: Acquisition of Part of House or Building

State: Central

(1) The provisions of this Act shall not be put in force for the purpose of acquiring a part only of any house, manufactory or other building, if the owner desires that the whole of such house, manufactory or building shall be so acquired: Provided that, if any question shall arise as to whether any land proposed to be taken under this Act does or does not form part of a house, manufactory or building within the meaning of this section, the Collector shall refer the determination of such question to the Authority concerned and shall not be taken possession of such land until after the question has been determined. (2) In deciding on such a reference made under the proviso to sub-section (1), the Authority concerned shall have regard to the question whether the land proposed to be taken, is reasonably required for the full and unimpaired use of the house, manufactory or building. (3) If, in the case of any claim under this Act, by a person interested, on account of the severing of the land to be acquired from his other land, the appropriate Government is of opinion that the claim is unreasonable or excessive, it may, at any time before the Collector has made his award, order.....

Title: Completion of Acquisition Not Compulsory, but Compensation to Be Awarded when Not Completed

(1) The appropriate Government shall be at liberty to withdraw from the acquisition of any land of which possession has not been taken. (2) Whenever the appropriate Government withdraws from any such acquisition, the Collector shall determine the amount of compensation due for the damage suffered by the owner in consequence of the notice or of any proceedings thereunder, and shall pay such amount to the person interested, together with all costs reasonably incurred by him in the prosecution of the proceedings under this Act relating to the said land.

Title: Provisions Relating to Rehabilitation and Resettlement to Apply in Case of Certain Persons Other Than Specified Persons

Title: Special Provisions for Scheduled Castes and Scheduled Tribes
