THE INTELLIGENCE ORGANISATIONS (RESTRICTION OF RIGHTS) ACT, 1985 [Act, No. 58 of 1985] [6th September, 1985] PREAMBLE An Act to provide for the restriction of certain rights conferred by Part III of the Constitution in their application to the members of certain organisations established by the Central Government for purposes of intelligence or counter-intelligence so as to ensure the proper discharge of their duties and the maintenance of discipline among them. BE it enacted by Parliament in the Thirty-sixth Year of the Republic of India as follows:-

.....of a member of an organised crime syndicate is, or, at any time has. been, in possession of movable or immovable property which he cannot satisfactorily account for, he shall be punishable with imprisonment for a term which shall not be less than three years but which may extend to ten years and shall also be liable to fine, subject to a minimum fine of rupees one lac and such property shall also be liable for attachment and forfeiture, as provided by section 20. SECTION 05: SPECIAL COURTS (1) The State Government may, by notification in the official Gazette, constitute one or more Special Courts for such area or areas, or for such case or class or group of cases, as may be specified in the notification. (2) Where any question arises as to the jurisdiction of any Special Court, it shall be referred to the State Government whose decision shall be final. (3) A Special Court shall be presided over by a judge to be appointed by the State Government, with the concurrence of the Chief Justice of the Bombay High Court. .....of a Terrorist Organisation (1) An application may be made to the Central Government for the exercise of its power under clause (c) of sub-section (1) of section 35 to remove an organisation from the Schedule. (2) An application under sub-section (1) may be made by-- (a) the organisation, or (b) any person affected by inclusion of the organisation in the Schedule as a terrorist organisation. (3) The Central Government may prescribe the procedure for admission and disposal of an application made under this section. (4) Where an application under sub-section (1) has been rejected, the applicant may apply for a review to the Review Committee constituted by the Central Government under sub-section (1) of section 37, within one month from the date of receipt of the order of such refusal by the applicant. .....means any person appointed to, or employed in, any Intelligence Organisation; (c) "prescribed" means prescribed by rules made under this Act. SECTION 03: RESTRICTIONS RESPECTING RIGHT TO FORM ASSOCIATION, FREEDOM OF SPEECH, ETC - (1) No member of an Intelligence Organisation shall,- (a) be a member of, or be associated in any way with, any trade union, labour union, political association or with any class of trade unions, labour unions or political associations; or (b) be a member of, or be associated in any way with, or raise funds for, or hold office in. or function in any other manner for, any other society, institution, association or organisation that is not recognised by the Central Government as part of the Intelligence Organisation of which he is a member or is not of a purely social recreational or religious nature; or (c) communicate with the press or publish or cause to be published any book, letter. pamphlet, poster or other document except with the prior permission of the head of the Intelligence Organisation; or (d) except for purposes of official duty, contact, or communicate with any person on any matter relating to functioning, structure, personnel.....

Title: Restrictions Respecting Right to Form Associations, Freedom of Speech, Etc.

.....be published any book, letter, pamphlet, poster or other document except with the prior permission of the head of the Intelligence Organisation; or (d) except for purposes of official duty, contact, or communicate with any person on any matter relating to functioning, structure, personnel or organisational affairs of the Intelligence Organisations of which he is a member; (e) use the name of the Intelligence Organisation of which he is a member for purposes not authorised by the head of the Intelligence Organisation or in any other manner except for purposes relating to the official work and functioning of the Organisation itself. Explanation.- If any question arises as to whether any society, institution, association or organisation is of a purely social, recreational or religious nature under clause (b) of this sub-section, the decision of the Central Government thereon shall be final. (2) No member of an Intelligence Organisation, shall participate in, or address, any meeting or take part in any demonstration organised by any body of persons for any political purposes or for such other purposes as may be prescribed.
