The Meghalaya Foodgrains [Licensing & Control] Order, 1985 Complete Act

.....SUP. 315 / 71 / PT. / 200, dated 23rd December, 1985. ::: In exercise of the Powers conferred by Sub " Clause " (d), (f), (h), (i) and (j) of Sub " Section " (2), of Section " 3, of the Essential Commodities Act, 1955, [Central Act, 10 of 1955], read with the Notification of the Govt. of India in the Ministry of Agriculture (Department of Food) NO. GSR. 800, dated the 09th June, 1978, with the prior concurrence of the Central Govt. of India and in supersession of the earlier Notification NO. SUP. 315 / 71 / PT. / 126, dated 21st December, 1984. The Governor of Meghalaya hereby make the following Order, namely: " 01. Short title, extend and commencement: " (1) This Order may be called the Meghalaya Foodgrains [Licensing and Control] Order, 1985. (2) It extends to the whole of the State of Meghalaya. (3) It shall come into force at once. 02. Definition: " In this Order, unless the context otherwise requires: " (a) "Director" means the Director of Supply, Meghalaya, and / or any other Officer duly Authorised by the State Govt. to exercise the Powers and discharge the duties of the Director under this Order; (b) "Deputy Commissioner" means the Deputy Commissioner of.....

.....under section 16, the Board is satisfied that a company has become a sick industrial company, the Board shall, after considering all the relevant facts and circumstances of the case, decide, as soon as may be by order in writing, whether it is practicable for the company to1[make its net worth exceed the accumulated losses] within a reasonable time. (2) If the Board decides under sub-section (1) that it is practicable for a sick industrial company to1[make its net worth exceed the accumulated losses] within a reasonable time, the Board, shall, by order in writing and subject to such restrictions or conditions as may be specified in the order, give such company as it may deem fit to1[make its net worth exceed the accumulated losses.] (3) If the Board decides under sub-section (1) that it is not practicable for a sick industrial company to2[make its net worth exceed the accumulated losses] within a reasonable time and that it is necessary or expedient in the public interest to adopt all or any of the measures specified in section 18 in relation to the said company it may, as soon as may be, by order in writing, direct any operating agency specified in the order to prepare,.....

Administrative Tribunals Act, 1985 Section 24

Title: Conditions as to Making of Interim Orders

State: Central

Notwithstanding anything contained in any other provisions of this Act or in any other law for the time being in force, no interim order (whether by way of injunction or stay or in any other manner) shall be made on, or in any proceedings relating to, an application unless- (a) copies of such application and of all documents in support of the plea for such interim order are furnished to the party against whom such application is made or proposed to be made; and (b) opportunity is given to such party to be heard in the matter: Provided that a Tribunal may dispense with the requirements of clauses (a) and (b) and make an interim order as an exceptional measure if it is satisfied, for reasons to be recorded in writing, that it is necessary so to do for preventing any loss being caused to the applicant which cannot be adequately compensated in money but any such interim order shall, if it is not sooner vacated, cease to have effect on the expiry of a period of fourteen days from the date on which it is made unless the said requirements have been complied with before the expiry of that period and the Tribunal has continued the operation of the interim order.

Title: Service of Notices and Orders

Any notice or order issued or made under this Chapter shall be served-- (a) by tendering the notice or order or sending it by registered post to the person for whom it is intended or to his agent; (b) if the notice or order cannot be served in the manner provided in clause (a), by affixing it on a conspicuous place in the property in relation to which the notice or order is issued or made or on some conspicuous part of the premises in which the person for whom it is intended is known to have last resided or carried on business or personally worked for gain.

Title: Execution of Orders of a Tribunal

Handlooms ( Reservation of Articles for Production) Act ,1985 Section 10

Title: Penalty for Contravention of Orders Made Under Section 3

State: Central

Year: 1985

Whoever produces any article or class of articles in contravention of an order made under section 3,- (a) shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to five thousand rupees per loom by which the said article or class of articles is produced, or with both, and in the case of a continuing contravention, with an additional fine which may extend to five hundred rupees per loom for every day during which such contravention continues after conviction for the first such contravention; and (b) the article or class of articles in respect of which the order has been contravened or any powerloom by the use of which such order is contravened, including any package, covering or receptacle in which the article or class of articles is found, shall be forfeited to the Central Government: Provided that if the court is of opinion that it is not necessary to direct forfeiture in respect of any of the articles, powerloom or any package, covering or receptacle, it may, for reasons to be recorded, refrain from doing so.

Title: Punishment for Contravention of Orders Made Under Section 9a

1[25A. Punishment for contravention of orders made under section 9A If any person contravenes an order made under section 9A, he shall be punishable with rigorous imprisonment for a term which may extend to ten years and shall also be liable to fine which may extend to one lakh rupees: Provided that the court may, for reasons to be recorded in the judgment, impose a fine exceeding one lakh rupees.] ______________________ 1.
