West Bengal Maintenance of Public Order Act, 1972 Complete Act

.....State Government may, from time to time, declare to be employment or class of employment essential to the life of the community; (g) "subversive act" means any act which is intended, or is likely , (i) to endanger public safety and tranquility, (ii) to organise, further or help the illegal acquisition, possession or use of (a) arms, ammunition or military stores as defined in the Arms Act, 1959; (b) explosive substances as defined in Explosive Substances Act, 1908, or corrosive substances; (iii) to commit an offence of looting or raiding under this Act or to further or help the commission thereof. Section 3 Effect of the provisions of the Act when inconsistent with other law The provisions of this Act and of any orders made thereunder shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force or in any instrument having effect by virtue of any such law. Section 4 Saving No prohibition, restriction or disability imposed by or under this Act, unless otherwise expressly provided by an order made by the State Government or by an officer specially authorised by the State Government in this behalf. shall apply to.....

In exercise of the Powers conferred by Sub- Clauses - (e), (h), (I) and (j), of Sub- Section - (2) of Section - 3 of the Essential Commodities Act, 1955, [ Central Act 10 of 1955 ] read with the Notification of the Govt. of India in the Ministry of Agriculture ( Department of Food ) NO. GSR. 316 (E), dated the 20th June, 1972, the Governor of Meghalaya hereby makes the following Order, namely :- 01. Short title, extend, application and commencement :- (a) This Order may be called the Meghalaya Foodstuffs [ Prohibition of With Holding and Sale ] Control Order , 1972 . (b) It extends to the whole of the State of Meghalaya. (c) It shall come into force at once. 02. Definition :- In this Order, unless there is anything repugnant in the subject or context:- (a) " Foodstuffs " means Pulses, Mustard Oil, other Edible Oils, Salt, Rice, Sugar and any other class of Commodities which the Govt. may, by notified Order, declare to be " Foodstuffs "for the purpose of this Order. (b) " Deputy Commissioner " includes the Additional Deputy Commissioner and the Sub- Divisional Officer within the respective.....

.....Year of the Republic of India as follows:-- Section 1 - Short title and commencement (1) This Act may be called the Uttaranchal [Uttar Pradesh Krishi Utpadan Mandi Samiti (Alpakalik Vyavastha) Adhiniyam, 1972] Adaptation and Modification Order, 2002 (First Amendment) Act, 2003. (2) It shall be deemed to have come into force on December 31, 2002. Section 2 - Amendment of Section 2 of the principal Act In Section 2 of the Uttaranchal [The Uttar Pradesh Krishi Utpadan Mandi Samiti (Alpakalik Vyavastha) Adhiniyam, 1972] Adaptation and Modification Order, 2002 for the words and figures "till December 31, 2002", the words and figures "till December 31, 2003" shall be substituted. Section 3 - Repeal and savings The Uttar Pradesh Krishi Utpadan Mandi Samiti (Alpakalik Vyavastha) Adhiniyam, 1972 Adaptation and Modification Order, 2002 (Uttaranchal Amendment) Adhyadesh, 2002 is hereby repealed. (3) It shall be applicable to the whole State of Uttaranchal. (2) Notwithstanding such repeal, anything done or any action taken under the Ordinance referred in sub-section (1), shall be deemed to have been done or taken under this Act, as if the provisions of this Act were in force at all material times. Title: Power of Central Government to Make Orders in Certain Cases to Ensure Parity

.....conditions as to refund adjustment or recovery), as may be specified therein, make such provisions as it may deem fit for securing, so far as may be, parity in such cases. (2) Any order under sub- section (1) may be made so as to have retrospective effect. (3) Every order made under sub- section (1) shall be laid, as soon as may be after it is made, before each House of Parliament while it is in session, for a total period of thirty days which may be comprised in one session or in two or more successive sessions, and if, before the expiry of the session immediately following the session or the successive sessions aforesaid, both House agree in making any modification in the order or both Houses agree that the order should not be made, the order shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that order. ] ____________________ 1. Any notice or order issued or made under this Chapter shall be served, (a) by tendering the notice or order or sending it by registered post to the person for whom it is intended or to his agent; (b) if the notice or order cannot be served in the manner provided in clause (a), then, by affixing it on a conspicuous place in the property in relation to which the notice or order is issued or made or on some conspicuous part of the premises in which the person for whom it is intended is known to have last resided or carried on business or personally worked for gain.

Title: Power of Central Government to Adapt Certain Rules, Regulations and Orders

(1) For the purpose of bringing the provisions of any rules and regulations made or deemed to have been made under the All-India Services Act, 1951 (61 of 1951) or any rules, regulations or order s (including any other instrument having the force of law) applicable immediately before the appointed day to or in relation to former Secretary of State Service officers into accord with the provisions of this Act, the Central Government may, before the expiry of two years from the appointed day, by order published in the Official Gazette, make such adaptations and modifications of such rules, regulations or orders, whether by way of repeal or amendment, as may be necessary. (2) The provisions of sub-section (1) shall be in addition to and not in derogation of any power under any other law to amend or repeal the rules, regulations and orders referred to in that sub-section.

Title: Power to Maintain Delimitation Orders Up-to-date

(1) The Election Commission may from time to time, by notification in the Gazette of India and in the Official Gazette of the State concerned, (a) correct any printing mistake in any of the orders made by the Delimitation commission under section 9 or any error arising therein from an inadvertent slip or omission; and (b) where the boundaries or name of any district or any territorial division mentioned in any of the said orders are or is altered, make such amendments as appear to it to be necessary or expedient for bringing the orders up-to-date, so, however, that the boundaries or areas or extent of any constituency shall not be changed by any such notification. (2) Every notification under this section shall be laid, as soon as may be after it is issued, before the House of the People and the Legislative Assembly of the State concerned.

Title: Power to Construe Rules, Regulations and Orders

Notwithstanding that no provision or insufficient provision has been made under section 9 for the adaptation of any rule regulation or order referred to in that section, any court, tribunal or authority, required or empowered to enforce such rule, regulation or order may construe it with such modifications as may be necessary to bring it into accord with the provisions of this Act.
