.....for Report of the Select Committee, see ibid, dated the 14th September, 1956.] PREAMBLE An Act to introduce and extend the prohibition of the manufacture, sale and consumption of intoxicating liquors in the drugs in the State of Orissa Whereas it is expedient as early as possible to bring about and extend the prohibition, except in respect of sacramental, medicinal, scientific, Industrial and such like purposes, of the production, manufacture, possession, export, import, transport, purchase, sale and consumption of intoxicating liquors and drugs in the State of Orissa; It is hereby enacted by the Legislature of the State of Orissa in the Seventh Year of the Republic of India as follows: Section 1 - Short title, extent and commencement (1) This Act may be called the Orissa Prohibition Act, 1956. (2) It extends to the whole of the State of Orissa. .....defence. Explanation.--Whether the provocation was grave and sudden enough to prevent the offence from amounting to murder is a question of fact. Illustrations (a) A, under the influence of passion excited by a provocation given by Z, intentionally kills. Y, Z"s child. This is murder, in as much as the provocation was not given by the child, and the death of the child was not caused by accident or misfortune in doing an act caused by the provocation. (b) Y gives grave and sudden provocation to, A, A, on this provocation, fires a pistol at Y, neither intending nor knowing himself to be likely to kill Z, who is near him, but out of sight. .....deem fit to make,-- (i) that his name has been entered in the Register by error or on account of misrepresentation or suppression of a material fact; (ii) that he has been convicted of any offence or has been guilty of any Infamous conduct in any professional respect, or has violated the standards of professional conduct and etiquette or the code of ethics prescribed under sub-section (1) which, in the opinion of the Council, renders him unfit to be kept in the Register. (4) An order under sub-section (3) may direct that any person whose name is ordered to be removed from the Register shall be ineligible for registration under this Act either permanently or for such period of years as may be specified.
