Title: Penalty for Illegal or Defective Supply or for Non-compliance with Order

.....lays down or places anyelectric supply-line or works outside the area of supply; or (b)being a licensee or a person who has obtained the sanction of the StateGovernment as aforesaid, in contravention of the provisions of this Act or ofthe rules thereunder, or in breach of the conditions of license or of thesanction, as the case may be, and without reasonable excuse, the burden ofproving which shall lie on himdiscontinues the supply of energy or fails to supply energy, or (c)makes default in complying with any of the provisions of an order or of anynotice or requisition issued under section 5 or section 6; or (d)makes default in complying with any directions issued to him under section 22A; or (e)makes default in complying with any order issued to him under section 22B or sub-section (2) of section 34, shallhe punishable with fine which may extend to one thousand rupees, and, in thecase of a continuing offence or default, with a daily line which may extend toone hundred rupees.] ________________________ 1. .....shall be deemed to be the time of purchase:" [Bihar Act 29 of 1950, Sec. 3 ]. For sub-sections (2) and (3) of Sec. 5 of the Indian Electricity Act, 1910 (Act IX of 1910) (hereinafter referred to as the said Act, the following subsections shall be substituted, namely : "(2) Where an undertaking is sold under sub-section (1), the purchaser shall pay to the licensee the amount payable for the undertaking determined in accordance with the provision of sub-sections (1) and (2) of Sec. 7-A. (3) Where the State Government issues any notice under sub- section ( 1 ) requiring the licensee to deliver on a date specified in the notice the undertaking to the designated purchaser pending the determination and payment of the amount payable for the undertaking: Provided that in any such case the purchaser shall pay to the licensee, interest at the Reserve Bank rate ruling at the time of delivery of the undertaking plus one per cent on the amount payable for the undertaking for the period from the date of delivery of the undertaking to the date of payment of the amount payable." Title: Penalty for Unauthorised Supply of Energy by Non-licensees

Whoever, in contravention of the provisions of section 28 engages in the business of supplying energy shall be punishable with fine which may extend to three thousand rupees, and in the case of a continuing contravention, with a daily fine which may extend to three hundred rupees.
