Karnataka Co-operative Societies Act, 1959 Section 53A

Title: Nomination of Members of Committee by State Government in Certain Cases

.....unable to be present himself at any meeting of the committee depute a subordinate officer to the meeting as his representative and such subordinate officer shall be deemed to be the person nominated as a representative of the State Government for purposes of such meeting. .....or any body or corporation constituted by or under any law for the time being in force, as a nominal or associate member;] Explanation.--In this sub-section "banking company" shall have the same meaning as is assigned to it in the Deposit Insurance Corporation Act, 1961 (Central Act 47 of 1961). Karnataka Stamp Act, 1957 Section 25

Title: How Transfer in Consideration of Debt or Subject to Future Payment, Etc., to Be Charged

.....part, as the case may be, of the consideration in respect whereof the transfer is chargeable with ad valorem duty: Provided that nothing in this section shall apply to any such certificate of sale as is mentioned in Article 15 of the Schedule. Explanation.- In the case of a sale of property subject to a mortgage or other encumbrance, any unpaid mortgage money or money charged, together with the interest (if any) due on the same, shall be deemed to be part of the consideration for the sale: Provided that, where property subject to a mortgage is transferred to the mortgage, he shall be entitled to deduct from the duty payable on the transfer the amount of any duty already paid in respect of the mortgage. Illustrations (1) A owes B Rs. 1,000. A sells a property to B the consideration being Rs. 500 and the release of the previous debt of Rs. 1,000. Stamp duty is payable on Rs. 1,500. (2) A sells a property to B for Rs. 500 which is subject to a mortgage to C for Rs. 1,000 and unpaid interest Rs. 200. Stamp duty is payable on Rs. 1,700. (3) A mortgages a house of the value of Rs. 10,000 to B for Rs. 5,000. B afterwards buys the house from A. Stamp duty is payable on.....

Karnataka Inland Fisheries (Conservation Development and Regulation) Act, 1996 Section 10

Title: Term of Office and Conditions of Service of Nominated Members

(1) Subject to the pleasure of the State Government and the provisions of section 11, the nominated members of the Board shall hold office for a period of three years from the date of their nomination. (2) Every nominated member may at any time resign his office by sending a letter of resignation addressed to the State Government: Provided that the resignation shall not take effect until it is accepted.

Karnataka Public Libraries Act, 1965 Section 19

Title: Nomination of Members in Default of Election

If any of the bodies referred to in section 17 or 18 does not by such period as may be prescribed elect or nominate a person to be a member of the City Library Authority or the District Library Authority, as the case may be, the State Government shall, by notification, nominate to the vacancy, a person qualified for election thereto; and the person so nominated shall be deemed to be a member of the Authority as if he had been duly elected by the said body.

.....authority: Provided further that for the purposes of this sub-section if a person is nominated to one authority and such person becomes a member of another authority by virture of the membership in the first mentioned authority, the period for which he has held office in first mentioned authority alone shall be taken into account. (2) Nothing in sub-section (1) shall have application in respect of,- (a) members referred to in sub-section (1), of section 19 not including members of the Executive Council who are not otherwise members of the Governing Council referred to in item (g); and (b) members referred to in clauses (a) to (d) of sub-section (1) of section 22.

Advocates Welfare Fund Act, 1983 Section 5

Title: Disqualification and Removal of Nominated Members of Trustee Committee

(1) A member nominated under clause (c) or clause (d) of sub-section (3) of section 4, shall be disqualified to be a member of the trustee committee, if he,- (a) becomes of unsound mind; or (b) is adjudged an insolvent; or (c) is absent without leave of the trustee committee, for more than three consecutive meetings thereof; or 1[(d) has committed breach of trust; or] (e) is convicted by a criminal court for an offence involving moral turpitude, unless such conviction has been set aside by a competent court. (2) The State Government may remove any member who is or has become disqualified under sub-section (1) from membership of the trustee committee: Provided that no order removing any member shall be passed unless that member and the Bar Council, in the case of a member nominated by it, have been given an opportunity of being heard. _______________________ 1.
