THE SIKKIM POLICE ACT, 2008 THE SIKKIM POLICE ACT , 2008 (Act No . 15 of 2008) AN ACT To make provision for the law relating to the establishment and management of the Police organization and its functions. Be it enacted by the Legislature of Sikkim in the Fifty-ninth Year of the Republic of India as follows: CHAPTER I Preliminary: Definitions and Interpretations Short title, extent and commencement 1. (1) This Act may be called the Sikkim Police Act, 2008. (2) It extends to the whole of Sikkim. (3) It shall come into force on such date as the State Government may by notification in the Official Gazette appoint. Definitions 2. THE SIKKIM MUNICIPALITIES ACT, 2007 THE SIKKIM MUNICIPALITIES ACT, 2007 (Act No. 5 of 2007) AN ACT To provide for the municipal governance in the State of Sikkim in conformity with the provisions of the Constitution of India as amended by the Constitution (Seventy-fourth Amendment) Act, 1992, based on the principles of participation in, and decentralization, autonomy, and accountability of, urban self-government at various levels, to improve the quality of life of the urban dwellers of Sikkim, to introduce reforms in financial management and accounting systems, to enhance internal resource generation capacity, to improve the organizational design of Municipalities, to ensure professionalization of the municipal personnel, and to provide for matters connected therewith or incidental thereto. THE SIKKIM PRISONS ACT, 2007 THE SIKKIM PRISONS ACT, 2007 (Act No. 16 of 2007) AN ACT To provide for a law regulating the prisons in Sikkim. Be it enacted by the Legislature of Sikkim in the Fifty-eighth Year of the Republic of India as follows: - CHAPTER I Short title, extent and commencement. 1. (1) This Act may be called the Sikkim Prisons Act, 2007 (2) It extends to the whole of Sikkim; (3) It shall come into force on such date as the State Government may, by notification, in the official gazette appoint. Definitions. In this Act, unless the context otherwise requires: - (a) "civil prisoner" means any prisoner who is not a criminal prisoner; 2 . (b) "Competent authority" means any officer having jurisdiction and legal authority to deal with a particular matter in question; (c) "convicted criminal prisoner" means any criminal prisoner under sentence of court or court-martial, and includes a person detained in prison under the provision of Code of Criminal Procedure, 1973; (d) "Court" includes any officer lawfully exercising civil, criminal or revenue jurisdiction; (e) "criminal prisoner" means any prisoner duly committed to custody.....
