Estate Duty and Tax on Railway Passenger Fares (Distribution) Act, 1957 Complete Act

.....POWER TO MAKE RULES (1) The Central Government notification in the Official Gazette, make rules providing for the manner in which the gross value of property is to be calculated, for the time at which, and the manner in which, any payments under this Act are to be made, for the making of adjustments between one financial year and an- other and for any other incidental or ancillary matters. (2) All rules made under this section shall, as soon as may be after they are made, be laid for not less than thirty days before each House of Parliament and shall be subject to such modifications as Parliament may make during the session in which they are so laid or the session immediately following. Notes: This section empowers the Central Government to frame rules pro- viding for the manner in which the gross value of property is to be calculated and the time and manner in which payments under the Act are to be made. Title: Levy of Excess Charge and Fare for Travelling Without Proper Pass or Ticket or Beyond Authorised Distance

.....or sub-section (2), as the case may be, or fifty rupees, whichever is more: Provided that if the passenger has with him a certificate granted under sub­section (2) of section 55, no excess charge shall be payable. (4) If any passenger liable to pay the excess charge and the fare mentioned in sub-section (1), or the excess charge and any difference of fare mentioned in sub-section (2), fails or refuses to pay the same on a demand being made therefor under one or other of these sub-sections, as the case may be, any railway servant authorised by the railway administration in this behalf may apply to any Metropolitan Magistrate or a Judicial Magistrate of the first or second class, as the case may be, for the recovery of the sum payable as if it were a fine, and the Magistrate if satisfied that the sum is payable shall order it to be so recovered, and may order that the person liable for the payment shall in default of payment suffer imprisonment of either description for a term which may extend to one month but not less than ten days. (5) Any sum recovered under sub-section (4) shall, as and when it is recovered, be paid to the railway administration.

Title: Lurking House-trespass or House-breaking by Night in Order to Commit Offence Punishable with Imprisonment

.....court may, for adequate and special reasons to be me ntioned in the judgment, impose a sentence of imprisonment for a term of less than three years". 2[ State of Uttar Pradesh Amendment of section 457 - section 457 of the principal Act shall be renumbered as sub­section (I) of that section and after sub section ( 1 ) as so renumbered, the following sub-section shall be added namely-- ( 2 ) Whoever commits lurking house trespass by night or house breaking by night in any building used as a place of worship in order to the committing of the offence of theft of any idol or icon from such buildings shall notwithstanding any thing contained in sub-section ( 1 ) be punished with rigorous imprisonment which shall not be less than three years but which may extend to fourteen years and with fine which shall not be less than five thousand rupees: Provided that the court may, for adequate and special reasons to be me ntioned in the judgment, impose a sentence of imprisonment for a term of less than three years. _________________ 1. Indian Penal Code (45 of 1860) Section 460

Title: All Persons Jointly Concerned in Lurking House-trespass or House-breaking by Night Punishable Where Death or Grievous Hurt Caused by One of Them

If, at the time of the committing of lurking house-1 res pass by night or house-breaking by night, any person guilty of such offence shall voluntarily cause or attempt to cause death or grievous hurt to any person, every person jointly concerned in committing such lurking house-trespass by night or house-breaking by night, shall be punished with1[imprisonment for life], or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine. ________________________ 1. Title: Prohibition of the Practice of Employing Persons for Carrying Night Soil as Head-load

.....if any person is convicted for the fifth time of an offence for the contravention of the provisions of sub-section (1) he shall be punished with imprisonment for a term which may extend to three months or with fine which may extend to three hundred rupees, or with both. (3) Nothing in this Act shall apply to any person who employs or allows himself to be employed for carrying night-soil as head-load or by the manual handling thereof in any hospital, clinic, nursing home or other similar institution or as a member of any organisation engaged in social service or to any person who himself carries or collects night-soil for the preparation, use or manufacture of manure.

Railways Act, 1989 Section 50

Title: Supply of Tickets on Payment of Fare

State: Central

Year: 1989

(1)Any person desirous of travelling on a railway shall, upon payment of the fare,be supplied with a ticket by a railway servant or an agent authorised in thisbehalf and such ticket shall contain the following particulars, namely:-- (i)the date of issue; (ii)the class of carriage; (iii)the place from and the place to which it is issued; and (iv)the amount of the fare. (2)Every railway administration shall display the hours during which bookingwindows at a station shall be kept open for the issue of tickets to passengers. (3)The particulars required to be specified on a ticket under clauses (ii) and(iii) of sub-section (1) shall,-- (a)if it is for the lowest class ofcarriage, be set forth in Hindi, English and the regional language commonly inuse at the place of issue of the ticket; and (b)if it is for any other class ofcarriage, be set forth in Hindi and English: Providedthat where it is not feasible to specify such particulars in any such languagedue to mechanisation or any other reason, the Central Government may exempt suchparticulars being specified in that language.
