SICK INDUSTRIAL COMPANIES (SPECIAL PROVISIONS) ACT, 1985 SICK INDUSTRIAL COMPANIES (SPECIAL PROVISIONS) ACT, 1985 1 of 1986 An Act to make in the public interest, special provision with a view to securing the timely detection of sick and potentially sick companies owning industrial undertakings, the speedy determination by a board of experts of the preventive, ameliorative, remedial and other measures which need to be taken with respect to such companies and the expeditious enforcement of the measures so determined and for matters connected therewith or incidental thereto. BE it enacted by Parliament in the Thirty-sixth Year of the Republic of India as follows :- CHAPTER 01: PRELIMINARY SECTION 01: SHORT TITLE, EXTENT, COMMENCEMENT AND APPLICATION (1) This Act may be called the Sick Industrial Companies (Special Provisions) Act, 1985. (2) It extends to the whole of India. .....every officer and other employee of the Authority shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code. Section 24 - Protection of action taken in good faith No suit, prosecution or other legal proceedings shall lie against any person for anything which is in good faith done or intended to be done under this Act or any rule or regulation made thereunder. (2) It extends- (a) in so far as it relates to the Central Administrative Tribunal, to the whole of India : (b) in so far as it relates to the Administrative Tribunals for States, to the whole of India, except the State of Jammu and Kashmir. .....the Central Government may, by notification in the Official Gazette, appoint, and different dates may be appointed for different provisions of this Act. SECTION 02: DEFINITIONS -In this Act, unless the context otherwise requires,- (a) "Authority" means the Agricultural and Processed Food Products Export Development Authority established under Section 4-; (b) "Chairman" means the Chairman of the Authority; (c) "export" means taking out of India by land, sea or air; (d) "exporter" means a person registered as an exporter of Scheduled products under Section 12-; (e) "member" means a member of the Authority and includes the Chairman; (f) "prescribed" means prescribed by rules made under this Act ; (g) "processing" in relation to Scheduled products includes the process of preservation of such products such as canning, freezing, drying, salting, smoking, peeling or filleting and any other method of processing which the Authority may, by notification in the Official Gazette, specify in this behalf; (h) "regulations" means regulations made under this Act ; (i) "Scheduled product" means any of the agricultural or processed food products included in the Schedule.
