.....Magistrate or a Magistrate of the first class shall take cognizance of or try any offence under this Act. SECTION 15: INDEMNITY TO PERSONS ACTING UNDER THIS ACT No suit, prosecution or other legal proceeding shall be instituted against any person for anything which is in good faith done or intended to be done under this Act, rules or bye-laws. SECTION 16: RULES (1) The Provincial Government may, by notification in the Official Gazette, make rules to carry out all or any of the purposes of this Act. (2) Without prejudice to the generality of the foregoing provisions such rules may prescribe- (a) the form of the application to be made under section 4, (b) the date on which an application for registration or renewal of registration to be made and the fees to be paid for such registration or renewal of registration, (c) the form of the certificate of registration to be issued under section 5, (d) for any other matter for which no provision has been made in this Act, and for which provision is, in the opinion of the Provincial Government, necessary. (3) The power to make rules under this section shall be subject to the condition of previous publication of the Official.....

Nursing Council Act, 1947 Complete Act

.....constitute an Indian Nursing Council in order to establish a uniform standard of training for nurses, midwives and health visitors; It is hereby enacted as follows :- This Act has been extended to the States merged in the State of Bombay: see Bom, Act 4 of 1950, section 3and Schedule II, Pt. I (30-3-1950). It is now extended to the Union territories of- (1)Dadra and Nagar Haveli, by Regn. 6 of l963; (2) Pondicherry, by Regn. 7 of 1963 (1-10-1963): (3) Goa, Daman and Diu, by Regn. 11 of 1963 (1-2-1965). SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called The Indian Nursing Council Act, 1947. (2)1[It extends to the whole of India except the State of Jammu and Kashmir.] (3) It shall come into force at once. Under s. 2(e) of the Monopolies and Restrictive Trade Practices Act, 1969, `India' means for the purposes of this Act the territories to which this Act extends (i.e., whole of India except the State of Jammu and Kashmir). SECTION 19: "JUDGE" The word "judge" denotes not only every person who is officially designated as a Judge, but also every person, who is empowered by law to give, in any legal proceeding, civil or criminal, a definitive judgement or a judgement which, if not appealed against, would be definitive, or a judgement which, if confirmed by some other authority, would be definitive, or who is one of a body of persons, which body of persons is empowered by law to give such a judgement.
