II, Section 2, Page 41 (No. 37)] 1S.O. 53(E).-In exercise of the powers conferred by sub-section (2) of Section 31 of the Hooghly Docking and Engineering Company Limited (Acquisition and Transfer of Undertakings) Act, 1984 (55 of 1984), the Central Government hereby makes the following rules, namely,- RULE 01: SHORT TITLE AND COMMENCEMENT (1) These rules may be called the Hooghly Docking and Engineering Company Limited (Acquisition and Transfer of Undertakings) Administration of Funds Rules, 1985. (2) They shall come into force on the date of their publication in the Official Gazette. RULE 02: DEFINITIONS In these rules unless the context otherwise requires,- (a) 'Act' means the Hooghly Docking and Engineering Company Limited (Acquisition and Transfer of Undertakings) Act, 1984 (55 of 1984); (b) 'Section' means a section of the Act; (c) 'Provident Fund' means the Provident Fund established by Messrs. Hooghly Docking and Engineering Company Limited for the benefit of persons employed in any of the under-takings owned by them. .....(AMDNDMENT) ACT, 2001 [Act No. 09 of 2001] [9th May,2001] PREAMBLE An Act further to amend the Narcotic Drugs and Psychotropic Substances Act, 1985. BE it enacted by Parliament in the Fifty-second Year of the Republic of India as follows: -- 1.Short title and commencement - (1) This Act may be called the Narcotic Drugs and Psychotropic Substances (Amendment) Act, 2001. (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint; and different dates may be appointed for different provisions of this Act, and any reference in any provision to the commencement of this Act shall be construed as a reference to the coming into force of that provision. 2. Amendment of section 1- In the Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985) (hereinafter referred to as the principal Act), in section 1, in sub-section (2), after the words "whole of India", the following shall be inserted, namely:-- "and it applies also-- (a) to all citizens of India outside India; (b) to all persons on ships and aircrafts registered in India, wherever they may be". 3. .....convention, relating to narcotic drugs or psychotropic substances which may be ratified or acceded to by India after the commencement of this Act. Title: Power of Entry, Search, Seizure and Arrest Without Warrant or Authorisation

Title: Conditions Under Which Search of Persons Shall Be Conducted

(1) When any officerduly authorised under section 42 is about to search any person under theprovisions of section 41, section 42 or section 43, he shall, if such person sorequires, take such person without unnecessary delay to the nearest GazettedOfficer of any of the departments mentioned in section 42 or to the nearestMagistrate. (2) If such requisitionis made, the officer may detain the person until he can bring him before theGazetted Officer or the Magistrate referred to in subsection (1). (3) The GazettedOfficer or the Magistrate before whom any such person is brought shall, if hesees no reasonable ground for search, forthwith discharge the person butotherwise shall direct that search be made. (4) No female shall besearched by anyone excepting a female. 1 [(5) When an officerduly authorised under section 42 has reason to believe that it is not possibleto take the person to be searched to the nearest Gazetted Officer or Magistratewithout the possibility of the person to be searched parting with possession ofany narcotic drug or psychotropic substance, or controlled substance or articleor document, he may, instead of taking such person to the nearest GazettedOfficer.....

.....detention and seizure under section 10, or (d) fraudulently evades tax payable under this Act, or (e) contravenes any of the provisions of this Act or rules made thereunder, shall be punishable with simple imprisonment which may extend to six months or with fine not exceeding one thousand rupees or with both and for the offence of contravention of sub-section (2) of section 10 the Court may, in addition to fine, order confiscation of his goods vehicle or stage carriages seized under section 10. (2) In any prosecution for an offence under this Act which requires a culpable mental state of the part of the accused, the Court shall presume the existence of such dupable mental state until the contrary is proved. Section 12 Compounding of offences Subject to such conditions as may be prescribed, any person alleged to have committed an offence under any of the clauses of sub-section (7) of section 11 may either before, or after, commencement of any proceedings against him in respect of such offence at his option compound such offence by paying to the prescribed authority such sum not exceeding five thousand rupees as may be determined by the prescribed authority.
