Title: Inapplicability of the Provisions of the Dock Workers (Regulation of Employment) Act, 1948 to Major Ports

The Central Government may, after settlement is arrived at between the Dock Labour Board of any major port, its workmen and the management of that major port in accordance with the provisions of the Industrial Disputes Act, 1947 (14 of 1947), direct, by notification in the Official Gazette that the provisions of the Dock Workers (Regulation of Employment) Act, 1948 (9 of 1948) shall cease to have effect in relation to that major port with effect from the date specified in that notification.

Major Port Trusts Act, 1963 Section 47A

Title: Constitution and Incorporation of Tariff Authority for Major Ports

.....from such date as the Central Government may, by notification in the Official Gazette, appoint there shall be constituted for the purposes of this Act an Authority to be called the Tariff Authority for Major Ports. (2) The Authority shall be a body corporate by the name aforesaid having perpetual succession and a common seal and shall by the said name sue and be sued. (3) The head office of the Authority shall be at such place as the Central Government may decide from time to time. (4) The Authority shall consist of the following Members to be appointed by the Central Government, namely :-- (a) a Chairperson from amongst persons who is or who has been a Secretary to the Government of India or has held any equivalent post in the Central Government and who has experience in the management and knowledge of the functioning of the ports; (b) a Member from amongst economists having experience of not less than fifteen years in the field of transport or foreign trade; (c) a Member from amongst persons having experience of not less than fifteen years in the field of finance with special reference to investment or cost analysis in the Government or in any financial.....

Title: Works and Services to Be Provided at Ports

.....which he has taken charge shall, subject to the other provisions of this Act, be that of a bailee under sections 151, 152 and 161 of the Indian Contract Act, 1872. Major Port Trusts Act, 1963 Section 46

Title: Power to Permit Erection of Private Wharves, Etc., Within a Port Subject to Conditions

(1) No person shall make, erect or fix within the limits of a port or port approaches any wharf, dock, quay, stage, jetty, pier, erection or mooring1[or undertake any reclamation of foreshore within the said limits] except with the previous permission in writing of the Board and subject to such conditions, if any, as the Board may specify. (2) If any person makes, erects or fixes any wharf, dock, quay, stage Jetty, pier, erection or mooring1[or undertakes any reclamation of foreshore] in contravention of sub-section (1), the Board may, by notice, require such person to remove it within such time as may be specified in the notice and if the person fails so to remove it, the Board may cause it to be removed at the expense of that person. ________________________ 1.
