Bangalore Water Supply and Sewerage Act, 1964 Section 39

Title: Power to Lay Mains

State: Karnataka

Year: 1964

.....controlled by the Government; (b) with the consent of every owner and occupier of any land not forming part of a street, in, over or on that land, and may, from time to time, inspect, repair, alter or renew or may at any time remove any main so laid whether by virtue of this section or otherwise: Provided that where a consent required for the purpose of this sub-section is withheld, the Board may, after giving the owner or occupier of the land a written notice of its intention so to do, lay the main in, over or on that land even without such consent. (2) Where the Board, in exercise of the powers under this section, lays a main in, over or on any land not forming part of a street or land referred to in clause (a) of sub-section (1), or inspect, repair, alter, renew or remove a main so laid down in, over or on any such land, it shall pay compensation to every person interested in that land for any damage done to, or injurious affection of that land by reason of the inspection, laying, repair, alteration, renewal or removal of the main.

The water supply department of the Government or the municipal council, as the case may be, in whom the duty of construction and maintenance of water works for supply of water to the 1 [municipal area] vests, shall have the same powers and be subject to the same restrictions for carrying, renewing and repairing water mains, pipes and ducts within or without the 1 [municipal area] as the municipal council has and is subject to, under the provisions hereinbefore contained for carrying, renewing and repairing drains within the 1 [municipal area]. _______________________________ 1. Title: Prohibition of Building over Water Mains

State: Karnataka

(1) Without the permission of the Board or the Water Supply Engineer, no building, wall or other structure shall be newly erected and no street shall be constructed over any Board water main. (2) If any building, wall or other structure be so erected or any street be so constructed, the Water Supply Engineer may cause the same to be removed or otherwise dealt with as the Water Supply Engineer deems fit and the expenses thereby incurred shall be paid by the persons contravening the provisions of sub-section (1).

.....connected with the Board water supply to be placed, removed, repaired or otherwise interfered with in contravention of the provisions of this Act or of the rules or regulations made thereunder: Provided that the Board shall not cut off the supply of water unless notice of not less than three days has been given to the owner or occupier of the premises. (2) (a) The owner and the occupier of the premises shall be jointly and severally liable for the payment of all the sums referred to in clause (c) of sub-section (1). (b) The sums referred to in clause (a) shall be a charge on the premises. (3) The expenses of cutting off the supply shall be payable by the owner and occupier of the premises jointly and severally. (4) In case under clause (c) of sub-section (1) as soon as any money for non-payment of which water has been cut off, together with the expenses of cutting off the supply, has been paid by the owner or occupier, the Board shall cause water to be supplied as before on payment of the cost of re-connecting the premises with the water works. Finance Act, 1964 Complete Act

.....cesser; andsection 6 of the General Clauses Act, 1897-, shall apply upon such cesser as if the said sub-section had then been repealed by a Central Act. Note: Tariff Act, 1934 is now repealed and replaced by the Customs Tariff Act, 1975 (51 of 1975). SECTION 58: REGULATORY DUTY OF CUSTOMS (1) There shall be levied and collected with effect from such date as may be specified in this behalf by the Central Government by notification in the Official Gazette, on all goods mentioned in the First Schedule tothe Tariff Actas amended by this Act or any subsequent Act of Parliament a regulatory duty of customs which shall be- (a) 25 per cent of the rate, if any, specified in the said First Schedule read with any notification issued under section 3 Aor sub-section ( 1 ) ofsection 4 of the Tariff Act; or (b) 10 per cent of the value of the goods as determined in accordance with the provisions ofsection 14 of the Customs Act, 1962-, whichever is higher: Provided that different dates may be specified by the Central Government for different kinds of goods. (2) Sub-section (1) shall cease to have effect after the 30th day of April, 1965 except as respects things done or omitted to be done.....

Karnataka Municipalities Act, 1964 Chapter III

Title: Transaction of Business by the Municipal Council

.....meeting that a resolution has been carried or lost, and an entry to that effect in the minutes of the proceedings shall, for the purposes of this Act, be conclusive evidence of the fact without proof of the number or proportion of the votes recorded in favour of or against such resolution. Karnataka Municipalities Act, 1964 Section 236

Title: Abatement of Nuisances from Wells, Etc.

.....house, is or is likely to become a breeding place of mosquitoes or in any other respect a nuisance, the municipal council may, by notice in writing, require the owner thereof to fill up, cover over or drain off the same in such manner and with such materials as the municipal council shall prescribe or to take such order with the same for removing or abating the nuisance as the municipal council shall prescribe. (2) (a) No new tank or pond shall be dug or constructed without the previous permission in writing of the municipal council. (b) If any such work is begun or completed without such permission, the municipal council may either, -- (i) by written notice require the owner or other person who has done such work to fill up or demolish such work in such manner as the municipal council shall prescribe; or (ii) grant written permission to retain such work; but such permission shall not exempt such owner from proceedings for contravening the provisions of clause (a) of this sub-section.
