THE KERALA PRESERVATION OF TREES (AMENDMENT) ACT, 2003 [1] ACT 28 OF 2003 THE KERALA PRESERVATION OF TREES (AMENDMENT) ACT, 2003 [1] An Act further to amend the Kerala Preservation of Trees Act, 1986 Preamble.--WHEREAS it is expedient to amend the Kerala Preservation of Trees Act, 1986, for the purpose hereinafter appearing; BE it enacted in the Fifty-fourth Year of the Republic of India as follows:-- 1. Short title and commencement.--(1) This Act may be called the Kerala Preservation of Trees (Amendment) Act, 2003. (2) It shall come into force at once. 2. Amendment of section 4.--In section 4 of the Kerala Preservation of Trees Act, 1986 (35 of 1986), after sub-section (5), the following sub-section shall be inserted, namely:-- "(6) Notwithstanding anything contained in this section or in any judgement, decree or order of any court, the owner of any land shall have the right to cut or cause to be cut any tree, other than a tree as defined in clause (e) of section 2, standing on such land, without obtaining a permission under this section.".
