Karnataka Panchayat Raj Act, 1993 Section 79

Title: Appointment of Joint Committees

State: Karnataka

.....of the Joint Committee. (4) The Government may by general or special order provide for the following matters, namely:- (a) the procedure of the Joint Committee; (b) The total number of members of the Committee; (c) The number of members to be appointed or elected under sub sections (2) and (3); (d) The manner of election or appointment under sub-sections (2) and (3); (e) The term of Office; (f) The powers of the committee which shall not be in excess of the powers that can be exercised by the local authorities or statutory bodies concerned; (g) the provisions of funds to the Joint Committee and its administration; (h) the manner of selection of the chairperson of Joint Committee; (5) The Joint Committee may be dissolved after serving the purpose for which it was constituted. (6) The Government may issue such direction as it thinks necessary in regard to the distribution of its assets and liabilities when the Joint committee is dissolved]. _______________ 1. Section 5 - Joint Commissioner of Excise and Deputy Commissioner of Excise 1[4A.2[Joint Commissioner of Excise and Deputy Commissioner of Excise].-- (1) The State Government may appoint, by notification, as many2[Joint Commissioners of Excise or Deputy Commissioners of Excise] as it thinks fit, for such area or areas as may be specified in the notification. (2)2[A Joint Commissioner of Excise or a Deputy Commissioner of Excise] appointed under sub-section (1), shall exercise such powers and perform such duties and functions assigned to a Deputy Commissioner under this Act, as may be specified by the State Government in the notification, and thereupon the Deputy Commissioner shall not be competent to exercise the powers or perform the duties and functions so specified. Karnataka Municipalities Act, 1964 Section 71

Title: Joint Committees of Local Bodies and Joint Levy of Toll

.....requiring the concurrence of such other local authority, not being a cantonment authority, in the matter aforesaid; and such other local authority shall comply with such orders. Karnataka Town and Country Planning Act, 1961 Section 51

Title: Joint Town Planning Schemes

.....of representatives of each of the several Planning Authorities duly elected in the prescribed manner and of persons nominated by the State Government. (3) Such Board, when duly constituted, shall make a declaration of the intention to make a Joint Town Planning Scheme in respect of the contiguous areas in the manner provided in section 29, and thereafter the Board shall have all the powers and be liable to all the duties of the Planning Authority under this Act and all the provisions in respect of procedure shall apply, so far as may be applicable. (4) The draft joint town planning scheme shall specify the parts of the scheme to be executed by the several Planning Authorities in the several contiguous areas and the several parts of the scheme shall, when notified in the final scheme, have effect in the several contiguous areas, as if they are separate schemes: Provided that any part of a Joint Town Planning Scheme may be executed jointly by two or more Planning Authorities.

Title: Revisional Powers of Joint Commissioner

(2) The Joint Commissioner shall not exercise any power under this section, if.- (a) the time for appeal against the order has not expired; or (b) more than four years have expired after the passing of the order sought to be revised. (3) The Joint Commissioner shall pass order under this section within a period of one year from the date of initiation of proceeding or calling for the records under this section, as the case may be. (4) Every order passed in revision under this section shall, subject to the provisions of sections 63 and 64 be final. (5) In computing the period of limitation for the purpose of sub-section (2), any period, during which any proceeding under this Section is stayed by an order or injunction of any court, shall be excluded. Karnataka Municipal Corporations Act, 1976 Section 75

Title: Joint Transaction with Other Local Authorities

State: Karnataka

.....as to the construction and future maintenance of any joint work and any power which might be exercised by any of such bodies: and (c) in framing and modifying rules for regulating proceedings of any such committees in respect of the purpose for which the committee is appointed. (2) When the corporation has requested the concurrence of any other local authority under the provisions of sub-section (1) in respect of any matter and such other local authority has refused to concur, the Government may pass such orders as it deems fit requiring the concurrence of such other local authority in the matter aforesaid and such other authority shall comply with such orders. (3) If any difference of opinion arises between the corporation and any other local authority which has joined the corporation under this section, the matter shall be referred to the Government whose decision thereon shall be final and binding on both the parties.
