(1) The State Government shall, by notification, constitute a Tree Authority for each urban area and for each rural area. (1) With effect on and from the appointed day, notwithstanding any custom, usage, contract or law for the time being in force, no person shall fell any tree or cause any tree to be felled in any land, whether in his ownership or occupancy or otherwise, except with the previous permission of the Tree Officer. (2) Any person desiring to fell a tree, shall apply in writing to the concerned Tree Officer for permission in that behalf. Where the Tree Officer has reason to believe that an offence under this Act is committed in respect of any tree, he may seize the tools or any boats, vehicles or other conveyances or animals used for the commission of said offence along with the tree or part thereof which has been severed from the ground or the trunk, as the case may be.
