Title: Amendment of Section 17a of Act 28 of 1954

In the High Court Judges (Salaries and Conditions of Service) Act, 1954, in section 17A, in sub-section (1),-- (i) for the words "sixty per cent. of the pension admissible to him", the words "fifty per cent. of his Salary" shall be substituted; (ii) for the words and thereafter at the rate of half of the family pension so admissible", the words "and thereafter at the rate of thirty per cent. of his salary" shall be substituted; (iii) before the Explanation, the following proviso shall be inserted, namely:-- "Provided that in no case the amount of family pension calculated under this sub-section shall exceed the pension payable to the Judge under this Act.".

In the Supreme Court Judges (Salaries and Conditions of Service) Act 1958, in section 16A, in sub-section (1),-- (i) in clause (a),-- (A) for the words "family pension calculated at the rate of sixty per cent. of the pension admissible to him", the words "family pension calculated at the rate of fifty per cent. of his salary" shall be substituted; (B) for the words "and thereafter at the rate of half of the family pension so admissible", the words "and thereafter at the rate of thirty per cent. of his salary" shall be substituted; (ii) in clause (b), for the words "family pension shall be thirty per cent. of the pension admissible", the words "family pension shall be thirty per cent. of his salary" shall be substituted; (iii) before the Explanation, the following proviso shall be inserted, namely:-- "Provided that in no case the amount of family pension calculated under this sub-section shall exceed the pension payable to the Judge under this Act.".

Title: Making of Application to Court of District Judge in Certain Cases

1[17A. Making of application to Court of District Judge in certain cases.-- In the case of a borrower residing in the State of Jammu and Kashmir, the application under section 17 shall be made to the Court of District Judge in that State having jurisdiction over the borrower which shall pass an order on such application. Explanation.- For the removal of doubts, it is hereby declared that the communication of the reasons to the borrower by the secured creditor for not having accepted his representation or objection or the likely action of the secured creditor at the stage of communication of reasons shall not entitle the person (including borrower) to make an application to the Court of District Judge under this section.".] ______________________ 1.
