Displaced Persons (Debts Adjustment) Act, 1951 Section 22

Title: Apportionment of Joint Debts

State: Central

Year: 1951

.....the debtor became a displaced person, and the value of the immovable property shall be deemed to be the value of the verified claim in respect thereof; (g) where the relationship between the joint debtors is that of principal and surety, nothing contained in this Act shall prevent the institution of a suit for the recovery of the debt against the surety but no decree shall be passed in such suit for an amount in excess of the amount decreed or which can be decreed against the principal debtor in accordance with the provisions of this Act: Provided that the total amount which may be recovered from the principal debtor and the surety shall not exceed the amount decreed or which can be decreed by the Tribunal against the principal debtor in accordance with the provisions of this Act.

(4) The Government may by general or special order provide for the following matters, namely:- (a) the procedure of the Joint Committee; (b) The total number of members of the Committee; (c) The number of members to be appointed or elected under sub sections (2) and (3); (d) The manner of election or appointment under sub-sections (2) and (3); (e) The term of Office; (f) The powers of the committee which shall not be in excess of the powers that can be exercised by the local authorities or statutory bodies concerned; (g) the provisions of funds to the Joint Committee and its administration; (h) the manner of selection of the chairperson of Joint Committee; (5) The Joint Committee may be dissolved after serving the purpose for which it was constituted. .....of Cochin" shall be, and shall be deemed to have been, omitted with effect on and from the 28 th day of December, 1971. 3. Substitution of new section for section 3." For section 3 of the Principal Act, the following section shall be substituted, namely:" "3 . Partition of the Estate and the Palace Fund ."(1) The senior most male member of the family shall, within sixty days from the date of commencement of the Valiamma Thampuran Kovilakam Estate and the Palace Fund. (Partition) and the Kerala Joint Hindu Family System (Abolition) Amendment Ordinance, 1978, direct the Board to effect partition of the Estate and the Palace Fund among all the members entitled to a share of the Estate and Palace Fund under section 4 of the Kerala Joint Hindu Family System (Abolition) Act, 1975 (30 of 1976), and such direction shall be published by the Board in the Gazette. (2) If the seniormost male member fails to direct the Board as required by subsection (1), the Board shall, on the expiry of the period specified in that subsection, proceed to effect the partition of the Estate and the Palace Fund among the members referred to in subsection (1), and the partition so effected shall be.....

Title: Any One of Joint Promisors May Be Compelled to Perform

Title: Power of Central Government to Supersede the Central Board and Joint Boards

.....sub-section (1), the Central Government may (a) extend the period of supersession for such further term, not exceeding six months, as it may consider necessary; or (b) reconstitute the Central Board or the Joint Board, as the case may be, by fresh nomination or appointment, as the case may be, and in such case any person who vacated his office under clause (a) of sub-section (2) shall not be deemed disqualified for nomination or appointment: Provided that the Central Government may at any time before the expiration of the period of supersession, whether originally specified under sub-section (1) or as extended under this sub-section, take action under clause (b) of this sub-section.

Title: Joint Sitting Both Chambers in Certain Cases

.....shall meet accordingly: Provided that, if it appears to the Governor-General that the Bill is such a Bill as is mentioned in the proviso to sub-section (1) of this, section, he may summon the Chambers to meet in a joint sitting for the purpose aforesaid at any date, whether in the same session or in the next session. (3) The functions of the Governor-General under the provisos to the two last preceding sub-sections shall be exercised by him in his discretion.
