Factoring Regulation Act, 2011, (Central) Section 17

Title: Modification of Original Contract

(1) Any agreement made before service of notice, under section 8, of the assignment of a receivable between the assignor and the debtor that affects the assignee's rights in respect of that receivable shall be effective as against the assignee, and the assignee shall acquire rights in the assigned receivables, as modified by such agreement. (2) Any agreement made, after notice of the assignment between the assignor and the debtor that affects the assignee's rights, shall be ineffective as against the assignee unless, (a) the assignee consents to it; or (b) the receivable is not fully earned by performance and either the modification is provided for in the original contract or, in the context of the original contract, a -reasonable assignee would consent to the modification, (3) Nothing contained in sub-sections (1) and (2) shall affect any right of the assignor or the assignee arising from breach of an agreement between them.

In section 9A of the Customs Tariff Act, after sub-section (1), the following sub-section shall be inserted, namely:- "(1A) Where the Central Government, on such inquiry as it may consider necessary, is of the opinion that circumvention of anti-dumping duty imposed under sub-section (1) has taken place, either by altering the description or name or composition of the article subject to such anti-dumping duty or by import of such article in an unassembled or disassembled form or by changing the country of its origin or export or far any other manner, whereby the anti dumping duty so imposed is rendered ineffective, it may extend the antidumping duty to such article or an article originating in or exported from such country, as the case may be."

THE TAMIL NADU PROHIBITION OF RAGGING ACT, 1997 THE TAMIL NADU PROHIBITION OF RAGGING ACT, 1997 (Act No.7 of 1997) An act to prohibit ragging in educational institution in the State of Tamil Nadu. Be it enacted by the Legislature Assembly of the State of Tamil Nadu in the Forty Eighth Year of the Republic of India as follows:- STATEMENT OF OBJECTS AND REASONS Ragging in its manifold form has become a menace not only to the student community particularly to fresh entrants but also it has got its ramification in the society at large. The administrative actions taken so far have been found ineffective. It has therefore been decided to prohibit ragging by law. To give effect to the above decision, the Tamil Nadu Prohibition of Ragging Ordinance, 1996 (Tamil Nadu ordinance 10 of 1996) was promulgated by the Governor on the 19th December, 1996 and the same was published in the Tamil Nadu Government Gazette Extraordinary, dated the 19th December 1996. 2. .....to him in this behalf or otherwise, that the registration of any establishment has been obtained by misrepresentation or suppression of any material fact or that the provisions of this Act are not being complied with in relation to any work carried on by such establishment, or that for any other reason the registration has become useless or ineffective and, therefore, requires to be revoked, he may, after giving an opportunity to the employer of the establishment to be heard, revoke the registration. Section 9 - Appeal (1) Any person aggrieved by an order made under section 8 may, within thirty days from the date on which the order is communicated to him, prefer an appeal to the appellate officer who shall be a person nominated in this behalf by the appropriate Government: Provided that the appellate officer may entertain the appeal after the expiry of the said period of thirty days if he is satisfied that the appellant was prevented by sufficient cause from tiling the appeal in time.
