.....OF CONDITIONS OF WORK) ACT, 1961[1] ACT 8 OF 1962 THE KERLA BEEDI AND CIGAR INDUSTRIAL PREMISES (REGULATION OF CONDITIONS OF WORK) ACT, 1961[1] An Act to regulate the conditions of work in beedi and cigar industrial premises in the State of Kerala. Preamble . "WHEREAS it is necessary to regulate the conditions of work in beedi and cigar industrial premises in the State of Kerala. Be it enacted in the Twelfth Year of the Republic of India as follows: " 1. Short title, extent and commencement. "(1) This Act may be called the Kerala Beedi and Cigar Industrial Premises (Regulations of Conditions of Work) Act, 1961. (2) It extents to the whole of the State of Kerala. (3) It shall come into force on such date as the Government may, by notification in the Gazette, appoint; and different dates may be appointed for different areas and for different provisions of the Act. 2. Definitions . "In this Act, unless the context otherwise requires, " a) "adult" means a person who has completed his eighteenth year of age; b) "beedi and cigar industrial premises" means any place or premises, including the precincts thereof, in any part of which any manufacturing process connected.....

Title: Certain Provisions Not to Apply to Industrial Premises

(1) Chapter IV and section 85 of the Factories Act, 1948 (62 of 1948) shall apply to an industrial premises and the rest of the provisions in that Act shall not apply to any industrial premises. (2) Nothing contained in any law relating to the regulation of the conditions of work of workers in shops or commercial establishments shall apply to any establishment to which this Act applies.

Section 6 - Functions of the Board (1) Subject to the provisions of this Act and the rules made there under, the Board shall render, in such manner, to such extent and on such terms and conditions as it may deem fit, financial and other assistance for the promotion of all such measures as are, in its opinion, conducive to the development of oil industry. (2) Without prejudice to the generality of the provisions of sub-section (1), the Board may render assistance under that sub-section by-- (a) making grants or advancing loans to any oil industrial concern or other person who is engaged or is to engage in any activity referred to in clause (k) of section 2; (b) guaranteeing on such terms and conditions as may be agreed upon loans raised by any oil industrial concern or other person which are repayable within a period not exceeding twenty-five years and are floated in the market or loans raised by an oil industrial concern or other person from any bank which is a scheduled bank, or a State co-operative bank, as defined.....

Title: Application of the Industrial Employment (Standing Orders) Act, 1946 and the Maternity Benefit Act, 1961

.....two months' notice of its intention so to do, by notification in the Official Gazette, apply all or any of the provisions of the Industrial Employment (Standing Orders) Act, 1946 (20 of 1946), to any industrial premises wherein less than fifty employees are employed or were employed on any one day of the preceding twelve months as if such industrial premises were an industrial establishment to which Act has been applied by a notification under sub-section (3) of section 1 thereof, and as if the employee in the said premises were a workman within the meaning of that Act. (3) Notwithstanding anything contained in the Maternity Benefit Act, 1961 (53 of 1961), the provisions of that Act shall apply to every establishment as if such establishment were an establishment to which that Act has been applied by a notification under sub-section (1) of section 2 thereof: Provided that the said Act shall, in its application to a home worker, apply subject to the following modifications, namely:-- (a) in section 5, in the Explanation to sub-section (1), the words "or one rupee a day, whichever is higher" shall be omitted; and (b) sections 8 and 10 shall be omitted.

Title: Resumption of the Possession of Premises Including the Residential Tenements on Breach of Terms and Conditions of Lease or Holding Without Authority

(3) After considering the cause, if any, shown by the allottee and after giving him an opportunity of being heard, the Board may pass such orders, as it deems fit. (4) Where the Board passes an order under sub-section (3), for resuming possession of the premises or part thereof or residential tenement in the industrial area it may, by notice in writing, order any allottee to surrender and deliver possession thereof to the Board or any person duly authorised in this behalf within the date specified in the notice. (5) If any allottee refuses to surrender or deliver the possession of the premises or part thereof or residential tenement within the time specified in the notice, the Board or any officer authorised by it in this behalf may resume the possession of the premises or part thereof or residential tenement free from all encumbrances and for that purpose may use force as may be necessary".] _________________________ 1. Title: Application of Karnataka Act 32 of 1974 to Board Premises

.....(Eviction of Unauthorised Occupants) Act, 1974] shall apply to premises belonging to, vesting in, or leased by, the Board as that Act applies in relation to public premises, but subject to the provisions of sub-section (2). Small Industries Developement Bank of India Act, 1989 Section 41

Title: Special Provisions for Enforcement of Claims by Small Industries Bank
