THE SIKKIM PRISONS ACT, 2007 THE SIKKIM PRISONS ACT, 2007 (Act No. 16 of 2007) AN ACT To provide for a law regulating the prisons in Sikkim. Be it enacted by the Legislature of Sikkim in the Fifty-eighth Year of the Republic of India as follows: - CHAPTER I Short title, extent and commencement. 1. (1) This Act may be called the Sikkim Prisons Act, 2007 (2) It extends to the whole of Sikkim; (3) It shall come into force on such date as the State Government may, by notification, in the official gazette appoint. Definitions. In this Act, unless the context otherwise requires: - (a) "civil prisoner" means any prisoner who is not a criminal prisoner; 2 . (b) "Competent authority" means any officer having jurisdiction and legal authority to deal with a particular matter in question; (c) "convicted criminal prisoner" means any criminal prisoner under sentence of court or court-martial, and includes a person detained in prison under the provision of Code of Criminal Procedure, 1973; (d) "Court" includes any officer lawfully exercising civil, criminal or revenue jurisdiction; (e) "criminal prisoner" means any prisoner duly committed to custody.....

.....a College or an Institution maintained by the University and includes, where there is no Principal, the person for the time being duly appointed to act as Principal, and in the absence of the Principal, or the acting Principal, a Vice-Principal duly appointed as such; (v) "recognised teachers" means such persons as may be recognised by the University for the purpose of imparting instructions in a College or an Institution admitted to the privileges of the University; (w) "Regional Centres" means off-campuses constituted by the University and functioning as part of the University, established in more tribal dominated areas, as prescribed in the Statutes; (x) "Regulations" means the Regulations made by any authority of the University under this Act for the time being in force; (y) "Scheduled Population" means and includes the Scheduled Tribes as well as Scheduled Castes, as defined in the Constitution of India; (z) "Statutes" and "Ordinances" mean, respectively, the Statutes and the Ordinances of the University, for the time being in force; (za) "teachers of the University" means Professors, Readers, Lecturers and such other persons as may be appointed for imparting.....

.....shall be substituted, namely:-- 'Explanation 2.--For the purposes of this sub-clause, "print media" means,-- (i) "newspaper" as defined in sub-section (1) of section 1 of the Press and Registration of Books Act, 1867(25 of 1867); (ii) "book" as defined in sub-section (1) of section 1 of the Press and Registration of Books Act, 1867(25 of 1867), but does not include business directories, yellow pages and trade catalogues which are primarily meant for commercial purposes;'; (h) after sub-clause (zzzw), the following sub-clauses shall be inserted, namely:-- '(zzzx) to any person, by the telegraph authority in relation to telecommunication service; (zzzy) to any person, by any other person in relation to mining of mineral, oil or gas; (zzzz) to any person, by any other person in relation to renting of immovable property for use in the course or furtherance of business or commerce. Explanation 1.--For the purposes of this sub-clause, "immovable property" includes-- (i) building and part of a building, and the land appurtenant thereto; (ii) land incidental to the use of such building or part of a building; (iii) the common or shared areas and facilities relating.....

(2) Save as otherwise provided in this Act, sections 2 to 93 shall be deemed to have come into force on the 1st day of April, 2007.
