BIDHAN CHANDRA KRISHI [VISWAVIDYALAYA] ACT, 1974 BIDHAN CHANDRA KRISHI [VISWAVIDYALAYA] ACT, 1974 49 of 1974 An Act to establish and incorporate a University at. Haringhata, in the district of Nadia, in West Bengal. Whereas it is expedient to establish and incorporate a University at Haringhata, in the district of Nadia, in West Bengal, for providing facilities for the study of agriculture, animal husbandry and allied sciences and for conducting researches in those sciences; It is hereby enacted as follows CHAPTER 1 Preliminary Section 1 Short title and extent (1) This Act may be called the Bidhan Chandra Krishi [Viswavidyalaya] Act, 1974. (2) It extends to the whole of West Bengal. Section 2 Definitions In tis Act, unless the context otherwise requires, 11. Clause (1) om. by W. B. Act 31 of 1981. (8) Where the Executive Council does not, within a reasonable time, take action to the satisfaction of the Visitor, the Visitor may, after considering any explanation furnished or representation made by the Executive Council, issue such directions as he may think fit and the Executive Council shall comply with such directions. (9) Without prejudice to the foregoing provisions of this section, the Visitor may, by order in writing annul any proceeding of the University which is not in conformity with this Act, the Statutes or Ordinances: Provided that before making any such order, he shall call upon the University to show cause why such an order should not be made and, if any cause is shown within a reasonable time, he shall consider the same. .....charge in respect of arrears of land revenue,- (a) no charge or mortgage created on any land or interest therein after the commencement of this Act in favour of the State Government or a co-operative society shall have priority over a charge or mortgage created on such land or interest by an agriculturist in favour of a credit agency as security for financial assistance given to him by such agency after the commencement of this Act and prior to the creation of the charge or mortgage in favour of the State Government or the co-operative society; and (b) any charge or mortgage created on any land or interest therein in favour of a credit agency as security for financial assistance given to an agriculturist by that credit agency shall have priority over any other charge or mortgage that may have been created over such land or interest in favour of any person other than the State Government, a co-operative society or any other financial institution prior to the date on which the charge or mortgage was created in favour of the credit agency.] (2) Where different charges or mortgages over the same land or any interest therein have been created or executed by an agriculturist.....

Title: Removal of Restrictions on Alienation

Notwithstanding anything contained in any law for the time being in force or any custom or usage having the force of law, it shall be lawful for an agriculturist to alienate the land or his interest therein whether or not a charge or mortgage is subsisting on such land or such interest, by creation of charge or mortgage of such land or interest therein in favour of a credit agency as security for the financial assistance given to him by such credit agency.
