.....and other activities; And WHEREAS the Company has the Capacity and infrastructure to effect an increase in the country's capacity to manufacture ships and other vessels and craft; And WHEREAS an increase in the production of such vessels and craft would reduce the need of the country to make imports of such vessels and craft and would thereby enable the country to save foreign exchange; And WHEREAS the Company is also engaged in the production of grey iron, non-ferrous and alloy castings which are essential to the needs of he economy of the country; And WHEREAS the Company had been suffering heavy losses for a number of years mainly due to lack of fresh investment and modernisation; And WHEREAS further investment of substantial sums of money is needed to run and modernise the undertakings of the Company: but in view of the serious adverse financial condition of the Company it is not in a position to secure such investment: And WHEREAS the liquidation of the Company, by reason of its inability to pay its debts, would prejudicially affect the country's capacity to manufacture such ships, vessels and craft and would thereby be prejudicial to the public.....

THE NATIONAL WATERWAY (ALLAHABAD-HALDIA STRETCH OF THE GANGA-BHAGIRATHI-HOOGHLY RIVER) ACT, 1982 [Act, No. 49 of 1982] [18th October, 1982] PREAMBLE An Act to provide for the declaration of the Allahabad-Haldia Stretch of the Ganga-Bhagirathi-Hooghly river to be a national waterway and also to provide for the regulation and development of that river for purposes of shipping and navigation on the said waterway and for matters connected therewith or incidental thereto. BE it enacted by Parliament in the Thirty-third year of the Republic of India as follows :

HOOGHLY RIVER BRIDGE ACT, 1969 HOOGHLY RIVER BRIDGE ACT, 1969 36 of 1969 15th November, 1969 An Act to re-enact, with modification, the provisions of the Hooghly River Bridges Act, 1968.WHEREAS the Hooghly River Bridges Act, 1968, providing for the construction, maintenance and control of bridges across the river Hooghly within the Port of Calcutta was enacted by the President of India during the period of operation of the Proclamation issued by the President of India on the 20th day of February, 1968, under article 356 of the Constitution of India in relation to the State of West Bengal; AND WHEREAS it is expedient to re-enact, with modification, the provisions of the said Hooghly River Bridges Act, 1968; It is hereby enacted as follows Section 1 Short title and application (1) This Act may be called the Hooghly River Bridge Act, 1969. (2) It shall apply to the Port of Calcutta as defined, from time to time, under section 5 of the Indian Ports Act, 1908. Section 2 Definitions In this Act, unless the context otherwise requires,- (a) "bridge" includes a tunnel; (b) "Chairman" includes a Vice-Chairman, if any, appointed by the State Government under sub-section.....

Government company, in which such undertakings have been vested under this Act, and in ratifying such contract, the Central Government or the Government company may make such alteration or modification therein as it may think fit: Provided that the Central Government or such Government company shall not omit to ratify a contract and shall not make any alteration or modification in a contract- (a) unless it is satisfied that such contract is unduly onerous or has been entered into in bad faith or is detrimental to the interests of the Central Government or the Government company; and (b) except after giving to the parties to the contract a reasonable opportunity of being heard and except after recording in writing its reasons for refusal to ratify the contract or for making any alteration or modification therein. SECTION 27: PROTECTION OF ACTION TAKEN IN GOOD FAITH - (1) No suit, prosecution or other legal proceeding shall lie against the Central Government or any officer or other employee of that Government or the existing, or new. (2) They shall come into force on the date of their publication in the Official Gazette. THE SCHEDULE [See section 2] LIMITS OF THE NATIONAL WATERWAY (ALLAHABAD-HALDIA STRETCH OF THE GANGA-BHAGIRATHI-HOOGHLY RIVER) From road bridge at Allahabad across the river Ganga, about 2 kms up-stream of the confluence of the rivers Ganga and Yamuna at Triveni to the Inland Waterway limit on the tidal waters of the river Hooghly from a line drawn between No. 1 Refuge house at the entrance to Baratola river commonly called channel creeek to a position 2.5 kms. due south of Saugor lighthouse, and then connected to the right or south bank at the entrance to the Hijili or Russulpore river, through river Ganga, lock canal and feeder canal at Farakka, river Bhagirathi and river Hooghly.
