THE CHILDREN ACT, 1960 THE CHILDREN ACT, 1960 [Act No. 60 of 1960 dated 26th. December, 1960] 1 An Act to provide for the care, protection, maintenance, welfare, training, education and rehabilitation of neglected or delinquent children and for the trial of delinquent children in the Union territories. Be it enacted by Parliament in the Eleventh Year of 'the Republic of India as follows: - CHAPTER I: PRELIMINARY SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Children Act, 1960. (2) It extends to all the Union territories. (3) It shall come into force in any Union territory on such date2 as the Administrator may, by notification in the Official Gazette, appoint and different dates may be appointed for different areas thereof. SECTION 02: DEFINITIONS In this Act, unless the context otherwise requires,- (a) "Administrator" means the administrator of a Union territory, whether called a Lieutenant Governor, a Chief Commissioner or by any other name; (b) "begging" means- (i) soliciting or receiving alms in a public place or entering on any private premises for the purpose of soliciting or receiving alms, whether under the pretence.....

.....Labour (Prohibition and Regulation) Act, 1986; (b) all forms of non-hazardous employment as defined in the Child Labour (Prohibition and Regulation) Act,1986 (Act61ofl986) and Goa, Daman and Diu Shops and Establishments Act, 1973 (Act No. 13 of 1974) and Goa, Daman and Diu Shops and Establishments Rules, 1975; (c) all forms of domestic employment, meaning employment in households, doing work of a domestic nature, either temporarily, permanently, piece-rated or part time;. (d) all forms of self employment meaning labour such as rag-picking, plastic bag selling, nut selling, running errands, carrying load of shoppers etc. (3) All Children who are identified as child labourers shall be immediately released therein and placed in a registered Children's Home or a State run institution or any other place identified under the Plan of Action. (4) The State shall ensure that a satisfactory Rehabilitation Programme is in position before taking action on this. (5) The punishment for violation of the provisions of this section shall be as unden- (a) for all forms of hazardous employment, a fine of Rs. 50,000/- (Rupees fifty thousand only) with simple imprisonment of one year for the.....

JUVENILE JUSTICE ACT, 1986 JUVENILE JUSTICE ACT, 1986 53 of 1986 An Act to provide for the care, protection, treatment, development and rehabilitation of neglected or delinquent juveniles and for the adjudication of certain matters relating to, and disposition of, delinquent juveniles. Juvenile Justice Act, 1986 [Repealed] Section 46

Title: Power of State Government to Discharge and Transfer Juveniles

(2) The State Government may, notwithstanding anything contained in this Act, order -- (a) a neglected juvenile to be transferred from one juvenile home to another ; (b) a delinquent juvenile to be transferred from one special home to another or from a special home to a borstal school where such school exists or from a special home to a juvenile home ; (c) a neglected juvenile or a delinquent juvenile to be transferred from a juvenile home or a special home to a fit person or a fit institution; (d) a juvenile who has been released on licence which has been revoked or forfeited, to be sent to the special home or juvenile home from which he was released or to any other juvenile home or special home or borstal school: Provided that the total period of the stay of the juvenile in a juvenile home or a special home or a fit institution or under a fit person shall not be increased by such transfer. (3) The State Government may, notwithstanding anything contained in this Act, at any time, discharge a Juvenile from the care of any person under whom he was placed under this Act either absolutely or on.....

Repeal and savings (1) As from the date of the cominginto force in any State1 of this Act, the Women's and Children'sInstitutions (Licensing) Act, 1956,1 or any other Act correspondingto this Act in force in that State immediately before such commencement, shallstand repealed. (2) Notwithstanding such repeal,anything done or any action taken (including any direction given, any registeror rule or order made or any restriction imposed) under the said Act shall,insofar as such thing or action is not inconsistent with the provisions of thisAct, be deemed to have been done or taken under the provisions aforesaid, as ifthey were in force when such thing was done or such action was taken, and shallcontinue in force accordingly until superseded by anything done or any actiontaken under this Act. ______________________ 1.This Act has been enforced in Kerala and Rajasthan so far. Naturally,Act 105 of 1956 stands repealed in those two States.

Orphanages and Other Charitabe Homes (Supervision and Control) Act, 1960 Complete Act

.....which it has approved; and thereupon the regulation shall have effect accordingly, but without prejudice to the exercise of the powers of the Board under sub-section (1). SECTION 31: REPEAL AND SAVINGS (1) As from the date of the coming into force in any State3of this Act, the Women's and Children's Institutions (Licensing) Act, 1956,' or any other Act corresponding to this Act in force in that State immediately before such commencement, shall stand repealed. (2) Notwithstanding such repeal, anything done or any action taken (including any direction given, any register or rule or order made or any restriction imposed) under the said Act shall, insofar as such thing or action is not inconsistent with the provisions of this Act, be deemed to have been done or taken under the provisions aforesaid, as if they were in force when such thing was done or such action was taken, and shall continue in force accordingly until superseded by anything done or any action taken under this Act.
