Title: Refusal to Hand over Charge to New Chairman or Vice-chairman

.....Market Committee is functioning for seizing and taking possession of the records, funds and property of the Market Committee in the possession of such Chairman or Vice-Chairman and handing over possession thereof to the successor-in-office. (4) On receipt of an application under sub-section (3), the Executive Magistrate may authorise any police officer, not below the rank of a sub-inspector, to enter and search any place where the records, funds and property are kept or are likely to be kept and to seize them and hand over possession thereof to the person specified in such application. (5) The provisions of the Code of Criminal Procedure, 1973, shall apply to every search and seizure made under this Act.

Title: Powers of Central Government to Hand over Estate of Deceased Persons to the Administrator-general

.....Act, 1913, an Administrator-General shall not interpose in any manner in relation to any property of a deceased which has been dealt with under section 171 or section 172 except in so far as he is expressly required or competent to do so by or under the provisions of this Act. (2) The Central Government may, at any time and in such circumstances as it thinks fit, direct that the estate of a deceased1[sailor] or officer shall be handed over by the commanding officer or the Committee of Adjustment, as the case may be, to the Administrator-General of a State for administration and thereupon such commanding officer or the Committee shall make over the estate to such Administrator-General. (3) Where under this section any estate is handed over to the Administrator-General, the latter shall administer such estate in accordance with the provisions of the Administrator-General's Act, 1913: Provided that where the estate is handed over to the Administrator-General before the ship and service debts and other debts in ship or quarters of the deceased are paid, it shall be the duty of the Administrator-General to pay these debts in priority to any debts due by the deceased. .....Judicial Magistrate of the First Class having jurisdiction shall, on an application made by the competent authority, by order, after notice to the Governing Council, direct the handing over of the custody of such properties, records or accounts of the institution to the competent authority within the time specified in such order. (b) Where the Governing Council fails to hand over the custody of the properties, records or accounts within the time specified in the order of the Magistrate under clause (a), it shall be punished with imprisonment which may extend to six months or with fine which may extend to two thousand rupees or with both, and the Magistrate shall cause the custody of the properties, records or accounts to be handed over to the competent authority taking such police assistance as may be necessary. (3) Nothing in this section shall apply to a private educational institution under the management of a charitable or religious institution, charitable or religious endowment or wakf.

Title: Penalty for Refusal to Hand over Charge to New President or Vice-president

(2) If the retiring president or vice-president or the president or vice-president, removed under sub-section (9) or (10) of section 42 fails or refuses to hand over charge of his office as required under sub-section (1) or subsection (3) of section 368, then without prejudice to any action under said sub-section, the Government or any authority empowered by the Government in this behalf, may, by order in writing, direct the president or the vice-president, as the case may be, to forthwith hand over charge of his office and all papers and property of the municipal council, if any, in his possession as such president or vice-president, to the new president or vice-president. (3) If the retiring president or vice-president or the president or vice-president removed under sub-section (9) or (10) of section 42 to whom a direction has been issued under sub-section (2) does not comply with such direction, he shall be punished with simple imprisonment for a term which may extend to one month or with fine which may extend to five hundred rupees or with both.

(1) If a councillor votes in contravention of section 80 or if any person actsas a councillor knowing that under this Act or the rules made thereunder he is not entitled or has ceased to be entitled to hold such office, he shall, on conviction, be punished with fine not exceeding two hundred rupees for every such offence. (2) If any person acts as or exercise the functions of the Mayor or deputy Mayor knowing that under this Act or the rules made thereunder he is not entitled or has ceased to be entitled to hold such office or to exercise such functions he shall, on conviction be punished with fine not exceeding one thousand rupees for every such offence. (3) If the Mayor or Deputy Mayor fails to hand over any documents of, or any money or other properties vested in or belonging to the corporation, which are in or have come into, his possession or control, to his successor in office or other prescribed authority, in every case as soon as his term of office as Mayor or Deputy Mayor expires and in the case of the Deputy Mayor also on demand by the Mayor, such Mayor or Deputy Mayor shall, on conviction, be punished with fine not exceeding one thousand rupees for every such.....

Where an undertaking has been voluntarily handed over by a company to the Government before the commencement of this Act, and the Government have taken possession of such undertaking, the provisions of this Act shall apply to such undertaking as if such undertaking vests in the Government under this Act. All the provisions of this Act shall accordingly apply to such undertaking: Provided that where under this Act any period is to be computed from the vesting date, such period shall, in relation to any undertaking to which this section applies, be computed from the date of the publication of this Act in the official Gazette.

.....be entitled to an interest at the rate of 4 per cent per annum on the amount of compensation payable to him under this Act in respect of the said land from the date on which such possession is taken till the date on which the final scheme in which such land is included comes into force or till the land is restored to the owner under sub-section (6), as the case may be. (6) If the Planning Authority has not executed any works on the land for which the land was vested in the Planning Authority under sub-section (3) within the period fixed under sub-section (2), the Town Planning Officer shall make or tender to the owner or the person interested in the land such compensation for the damage, if any, done to the land as he may think reasonable and shall restore the land to the owner or person interested therein.

THE KOVALAM PALACE (TAKING OVER BY RESUMPTION) ACT 2005[1] THE KOVALAM PALACE (TAKING OVER BY RESUMPTION) ACT 2005 [1] ACT 25 OF 2005 An Act to provide for taking over and protection by resumption of the historic site of Kovalam Palace and the surrounding buildings and lands by the Government of Kerala Preamble: -WHEREAS, the Government of Kerala had sanctioned the possession of the Kovalam Palace and the adjacent property measuring 4.13.30 hectares along with other lands to the Department of Tourism. Government of India in the year 1970 for the purpose of development of tourism in-Kerala pending finalization of the terms and conditions of transfer. AND WHEREAS, the terms and conditions of transfer have not been finalized thereafter, AND WHEREAS, the India Tourism Development Corporation the agency of the Department of Tourism, Government of India which had been in possession of the Kovalam Palace and the surrounding buildings and lands had transferred the possession of the buildings and lands to M/s.
