Registration Act, 1908 Section 26

Title: Documents Executed out of India

Year: 1908

When a document purporting to have been executed by all or any of the parties out of1[India] is not presented for registration till after the expiration of the time hereinbefore prescribed in that behalf, the registering officer, if satisfied-- (a) that the instrument was so executed, and (b) that it has been presented for registration within four months after its arrival in1[India], may, on payment of the proper registration-fee accept such document for registration. ________________________ 1. Indian Ports Act, 1908 Section 26

Title: Leaving out Warp or Hawser After Sunset

State: Central

Year: 1908

(1) A master of a vessel shall not cause or suffer any warp or howser attached to his vessel to be left out in any port subject to this Act after sunset in such a manner as to endanger the safety of any other vessel navigating in the port. (2) A master offending against Sub-section (1) shall be punishable for every such offence with fine which may extend to two hundred rupees.

Explanation II : For the purposes of this section, a transaction is a commercial transaction, if it is connected with the industry, trade or business of the party incurring the liability.] (2) Where such a decree is silent with respect to the payment of further interest on such principal sum] from the date of the decree to the date of payment or other earlier date, the court shall be deemed to have refused such interest, and a separate suit therefor shall not lie.
