Title: Punishment of Grave Breaches of Conventions

.....other case, with imprisonment for a term which may extend to fourteen years. (2) Sub-section (1) applies to persons regardless of their nationality or citizenship. (3) For the purposes of this section,- (a) a grave breach of the First Convention is a breach of that Convention involving an act referred to in article 50 of that Convention committed against persons or property protected by that Convention; (b) a grave breach of the Second Convention is a breach of that Convention involving an act referred to in article 51 of that Convention committed against persons or property protected by that Convention; (c) a grave breach of the Third Convention is a breach of that Convention involving an act referred to in article 130 of that Convention committed against persons or property protected by that Convention; and (d) a grave breach of the Fourth Convention is a breach of that Convention involving an act referred to in article 147 of that Convention committed against persons or property protected by that Convention.

Title: Prohibition Against Making of Vault or Grave in Any Place of Public Worship

State: Karnataka

Year: 1976

No person shall make a vault or grave, or cause any corpse to be buried within the walls or underneath any place of public worship: Provided that the Commissioner may, subject to the general or special orders of the Government, authorise the making of a vault or grave within the precincts of or underneath any place of public worship and the burial of priests or religious ministers in such vault or grave, or in an existing vault or grave.

Title: Prohibition of Making of Vault or Grave in Place of Worship

(1) No person shall make a vault or grave, or cause any corpse to be buriedwithin the walls or underneath any place of public worship: Provided that the Municipal Commissioner or Chief Officer may, subject to the general or special orders of the Government, authorise the making of a vault or grave within the precincts of or underneath any place of public worship and the burial of priests, sanyasis or ministers of religion in such vault or grave, or in an existing vault or grave. (2) Any person who contravenes the provisions of sub-section (1), shall be punishable with fine which may extend to one hundred rupees.

Indian Penal Code (45 of 1860) Section 352

Title: Punishment for Assault or Criminal Force Otherwise Than on Grave Provocation

State: Central

Year: 1860

Whoever assaults or uses criminal force to any person otherwise than on grave and sudden provocation given by that person, shall be punished with imprisonment of either description for a term which may extend to three months, or with fine which may extend to five hundred rupees, or with both. Explanation.--Grave and sudden provocation will not mitigate the punishment for an offence under this section. If the provocation is sought or voluntarily provoked by the offender as an excuse for the offence, or if the provocation is given by anything done in obedience to the law, or by a public servant, in the lawful exercise of the powers of such public servant, or if the provocation is given by anything done in the lawful exercise of the right of private defence. Whether the provocation was grave and sudden enough to mitigate the offence, is a question of fact.

Title: Assault or Criminal Force with Intent to Dishonour Person, Otherwise Than on Grave Provocation

Whoever assaults or uses criminal force to any person, intending thereby to dishonour that person, otherwise than on grave and sudden provocation given by that person, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both. STATE AMENDMENTS 1Andhra Pradesh offence under Section 355 is non-cognizable, bailable and triable by any Magistrate. _______________________ 1. Title: Assault or Criminal Force on Grave Provocation

Year: 1860

Whoever assaults or uses criminal force to any person on grave and sudden provocation given by that person, shall be punished with simple imprisonment for a term which may extend to one month, or with fine which may extend to two hundred rupees, or with both. Explanation.--The last section is subject to the same Explanation as section 352.

Title: Graving Vessel Within Prohibited Limits

Karnataka Municipal Corporations Act, 1976 Section 397

Title: Prohibition Against Use of Burial and Burning Grounds Dangerous to Health or Overcrowded with Graves

State: Karnataka

Year: 1976

(1) If the Commissioner is of opinion,- (a) that any registered or licensed place for the disposal of the dead or any place provided for such disposal by the Corporation or by the Government is in such a state or situation as to or to be likely to become dangerous to health of persons living in the neighbourhood thereof; or (b) that any burial ground is overcrowded with graves, and if in the case of a public or burning ground or other place as aforesaid another convenient place duly authorised for the disposal of the dead exists or has been provided for the persons who would ordinarily make use of such place, he may with the consent of the corporation and the previous sanction of the Government, give notice that it shall not be lawful after a period to be named in such notice, to bury, burn or otherwise dispose of any corpse at such place. (2) Every notice given under sub-section (1) shall be affixed to some part of such place. (3) After the expiry of the period named in such notice it shall not be lawful to bury, burn or otherwise dispose of a corpse at such place except with the permission of the Commissioner.

No person shall discharge the office of a grave digger or other attendant at a public place for the disposal of the dead (other than a place provided by the Government) unless he has been licensed in that behalf by the Commissioner.

.....power to sentence him to death or to imprisonment for a term of two years or more, shall not proceed with the trial until it is proved to the satisfaction of the Court that a notice containing the particulars mentioned in the next following sub-section, so far as they are known to the prosecutor, has been served not less than three weeks previously on the protecting power (if there is a protecting power) and, if the accused is a protected prisoner of war, on the accused and the prisoners' representative. (2) The particulars referred to in the foregoing sub-section are - (a) the full name and description of the accused, including the date of his birth and his profession or trade, if any, and, if the accused is protected prisoner of war, his rank and arm, regimental, personal or serial number; (b) his place of detention, internment or residence; (c) the offence with which he is charged- and (d) the Court before which the trial is to take place and the time and place appointed for the trial. (3) For the purposes of this section a document purporting - (a) to be signed on behalf of the protecting power or by the prisoners representative or by the person accused, as the case may.....
