THE ORISSA GIFT GOODS (UNLAWFUL POSSESSION) ACT, 1964 THE ORISSA GIFT GOODS (UNLAWFUL POSSESSION) ACT, 1964 ORISSA ACT 13 OF 1964 [Received the assent of the Governor on the 19th November 1964, first published in an extraordinary issue of the Orissa Gazette, dated the 24th November 1964] AN ACT TO PROVIDE FOR PUNISHMENT FOR UNLAWFUL POSSESSION OF GIFT GOODS SUPPLIED BY CERTAIN RELIEF ORGANISATIONS BE it enacted by the Legislature of the State of Orissa in the Fifteenth Year of the Republic of India, as follows:- Short title extent and commencement. 1 . (1) This Act may be called the Orissa Gift Goods (Unlawful Possession) Act, 1964. (2) It shall extend to the whole of the State of Orissa. (3) It shall come into force at once. Definitions 2 . In this Act unless the context otherwise requires:- (a) ˜gift goods' means any of the following goods, namely:- (i) cornmeal; (ii) milk powder; (iii) vegetable oil; Supplied by way of gift, by any relief organisation to any State Government or to the Central Government or to any other person on behalf of such Government; (b) ˜relief organisation' means any organisation specified in the.....

.....or is proved to have been , in possession of any gift goods reasonably suspected of being stolen or unlawfully obtained, and cannot account satisfactorily how he came by the same, he shall be punished with imprisonment for a term which may extend to two years, or with fine, or with both. Offence under the Act to be cognizable: - 4. (1) Notwithstanding anything contained in the Code of Criminal Procedure, 1898 (Central Act V of 1898), any offence under this Act shall be deemed to be a cognizable offence within the meaning of that Code. ( 2) No Court below that of a Magistrate of the First Class shall try any offence under this Act. Power to amend Schedule:- 5. The Administrator may, by notification, add any organization to, or omit any organization from the Schedule and on the publication of such notification, such organization shall be deemed to be included in, or as the case may be, omitted from, the Schedule. Notifications to be placed before the Legislature: - 6. (1) Every notification issued under this Act shall come into force on the day on which it is published. Title: Failure to Pay Rent and to Keep Water Course in Good Repair

If the applicant in whose favour an order under sub-section (2) of section 90A was made,-- (a) fails to pay the amount of compensation or the amount of the rent, itshall be recovered as an arrear of land revenue on an application made to the Tahsildar by the person entitled thereto; (b) fails to maintain the water course in good condition and fit state ofrepairs, he shall be liable to pay such compensation as may be determined by the Tahsildar for any damage caused on account of such failure.

Title: Damage to Municipal Property How Made Good

If through any act, neglect or default, on account whereof any person shall have incurred any penalty imposed by or under this Act, any damage to the property of the municipal council shall have been committed by such person, he shall be liable to make good such damage as well as to pay such penalty, and the amount of damage shall, in case of dispute, be determined by the magistrate by whom the person incurring such penalty is convicted, and on non-payment of such damage on demand, the same shall be levied by distress, and such magistrate shall issue the warrant accordingly.
