It came into force on the following areas on the 16th April, 1951 vide Notification No. 3000-L.S.G. 16.4.1951. published in the Orissa Gazette Ext. of the even date. Areas- Cuttack, Jajpur, Bhawanipatna, Purl, Berhampur, Balasore, Paralakhemundi, Dhenkanal, Sambalpur, Barlpada, Keonjhar, Kendrapara, Bolangir, Deogarh, Sonepur and Sundergarh. Title: Prohibition of Improper Use of Certain Emblems and Names

Notwithstanding anything contained in any law for the time being in force, no person shall, except in such cases and under such conditions as may be prescribed by the Central Government, use or continue to use for the purpose of any trade, business, calling or profession, or in the title of any patent, or in any trade mark or design, any name or emblem specified in the Schedule or any colourable imitation thereof without the previous permission of the Central Government or such officer of Government as may be authorised in this behalf by the Central Government.

Title: Prohibition of Registration of Certain Companies, Etc.

(1) Notwithstanding anything contained in any law for the time being in force, no competent authority shall,-- (a) register any company, firm or other body of persons which bears any name, or (b) register a trade mark or design which bears any emblem or name, or (c) grant a patent in respect of any invention which bears a title containing any emblem or name, the use of which name or emblem is in contravention of section 3. (2) If any question arises before a competent authority whether any emblem is an emblem specified in the Schedule or a colourable imitation thereof, the competent authority may refer the question to the Central Government and the decision of the Central Government thereon shall be final.

KHADDAR (PROTECTION OF NAME) ACT, 1950 KHADDAR (PROTECTION OF NAME) ACT, 1950 "The Khaddar (Name Protection) Act, 1934, was enacted to prevent the improper use of the words 'Khaddar' and Khadi', but its provisions were not effective to prevent the sale of spurious Khadi as genuine Khadi. The Act also did not cover genuine silk and woolen khadi fabrics. 2. The object of the present Bill is to enlarge the existing definitions of 'Khaddar' and 'Khadi' to cover silk and woollen fabrics, incidentally extending the Act to the whole of India except Jammu and Kashmir. It is intended to follow up this law by laws passed by the Legislatures of the States providing for the licensing of dealers in Khaddar and Khadi and the prohibition of the sale of such materials, except by licensed dealers or by dealers holding certificates from the All India Spinners' Association". - Gazette of India, 1950, Pt.
