THE MADRAS IRRIGATION TANKS (IMPROVEMENT) ACT, 1949 THE MADRAS IRRIGATION TANKS (IMPROVEMENT) ACT, 1949 [Act No. 19 of 1949] PREAMBLE An Act to empower the Provincial Government to increase the capacity and efficiency of irrigation tanks in the Province of Madras. Whereas it is expedient to empower the Provincial Government to increase the capacity and efficiency of irrigation tanks in the Province of Madras; It is hereby enacted as follows:- ____________ Published in the Fort St. George Gazette dt. 19-7-1949, ------------------ Section 1 - Short title, extent and commencement (1) This Act may be called the Madras Irrigation Tanks (Improvement) Act, 1949. (2) It extends to the whole of the Substituted by the Adaptation Order of 1950 [State] of Madras. (3) It shall come into force at once. Section 2 - Definitions In this Act, unless there is anything repugnant in the subject or context- (a) "Government" means the Substituted for the word "Provincial" [State] Government; Inserted by Act 7 of 1980 and again by Act 16 of 2000 [(aa) "District Collector" means the Secretary as defined in clause (43) of section 2 of the Kerala Municipality Act,.....

.....No Court shall entertain any suit or application for the issue of an injunction to restrain exercise of any powers conferred on the Government by section 3. SECTION 5: Compensation (1) Where in consequence of anything done in pursuance of section 3, the owner of any land or property sustains loss or damage, he shall be entitled to such compensation as the District Collector may by order determine: Provided that where the loss or damage was sustained by reason of the diminution of the supply of water to any land or to any tank or other source from which water is supplied to any land, compensation shall be payable only in such cases, and to such extent, as may be prescribed. (2) No compensation shall be payable to any person under sub-section (1), unless he has preferred to the District Collector, an application in that behalf setting forth the grounds of his claim, within three years from the date on which the loss or damage was sustained or such further time as the District Collector may think fit to allow. (3) On receipt of an application under sub-section (2), the District Collector shall hold an enquiry in the prescribed manner. (4) The Compensation payable to any.....

Title: Power to Require Unwholesome Tanks or Private Premises to Be Cleansed or Drained

(1) The Nagar Panchayat or the Council may require the owner or occupier of any land within eight days or such longer period as the Nagar Panchayat or the Council may fix, either to re-excavate or at his option fill up with suitable material or to cleanse any well, water-course, private tank or pool therein, and to drain off and remove any waste or stagnant water which may appear to be injurious to health or offensive to the neighbourhood: Provided that if, for the purpose of effecting any drainage under this section, it shall be necessary to acquire any land not being the property of the person who is required to drain his land or to pay compensation to any other person, Nagar Panchayat or as the case may be, the Council shall provide such land and pay such compensation. (2) If under the provisions of this Act the Nagar Panchayat or the Council execute the work of such re-excavation or filling up with suitable material, it may take possession of the tank or pool or the sites of such tank or pool and retain such possession and turn the same to profitable account until the expenses thereby incurred shall have been realised.

Title: Wells, Tanks, Etc., to Be Secured

If any well, tank or other excavation, whether on public or private ground, be, for want of sufficient repair or protection, dangerous to possers by the Nagar Panchayat or as the case may be, the Council shall forthwith require by notice such owner or occupier, or both within eight days, properly to secure or protect such well, tank or other excavation; and if after the said period the work is not executed, the Nagar Panchayat or as the case may be, the Council shall cause a temporary hoard or fence to be put for the protection of passers-by and recover the expenses so incurred from the owner or occupier or the owners and occupiers of the land on which such tank, well or other excavation is situated.

(1) If the Chairperson is of opinion that the water in any well, tank or other place, is likely, if used for drinking, to endanger, or cause the spread of, any disease, he may- (a) by public notice, prohibit the removal or use of such water for drinking; or (b) by notice in writing require the owner or person having control of such well, tank or place to take such steps as may be directed by the notice to prevent the public from having access to or using such water; or (c) take such other steps as he may consider expedient to prevent the outbreak or spread of any such disease. (2) In the event of New Delhi or any part thereof being visited or threatened by an outbreak of a dangerous disease the officer authorised by the Chairperson in this behalf may, without notice and at any time, inspect and disinfect any well, tank or other place from which water is, or is likely to be, taken for the purposes of drinking and may further take such steps as he may think fit to ensure the purity of the water or to prevent the use of the same for drinking purposes.

Title: Control over Wells, Tanks, Etc.

(1) If the Chief Executive Officer on the advice given by the Health Officer is of opinion that the water in any well, tank or other place is likely, if used for drinking, to endanger, or cause the spread of, any disease, it may,-- (a) by public notice, prohibit the removal or use of such water for drinking; (b) by notice in writing, require the owner or person having control of such well, tank or place to take such steps as may be directed by the notice to prevent the public from having access to or using such water; or (c) take such other steps as it may consider expedient to prevent the outbreak or spread of any such disease. Title: Filling Up of Tank, Etc

(1) Where any well, tank, cistern, reservoir, receptacle or other place in the cantonment where water is stored or accumulates, whether within any private enclosure or not, is in such a condition as to create a nuisance or, in the opinion of the Health Officer, or the Assistant Health Officer, is or is likely to be a breeding place for mosquitoes, the1[Board] may, by notice in writing, require the owner, lessee or occupier thereof within such period as may be specified in the notice, to fill up or cover the well, cistern, reservoir or receptacle, or to fill up the tank, or to drain off or remove the water, as the case may be. Title: Filling Up of Tank Etc.

State: Central

Year: 2006

(1) Where any well, tank, cistern, reservoir container, desert cooler or any other, receptacle or place in the cantonment where water is stored or accumulated, whether within any private enclosure or not, is in such a condition as to create a nuisance or, in the opinion of the Health Officer, is or is likely to be a breeding place for mosquitoes, the Board may, by notice in writing, require the owner, lessee or occupier thereof within such period as may be specified in the notice, to fill up or cover the well, cistern, reservoir or receptacle, or to fill up the tank, or to drain off or remove the water, as the case may be. (2) The Board may from time to time take such measures as are necessary in its opinion for prevention of breeding of mosquitoes, insects or any bacterial or viral carriers of disease in public places under the control or management of the Board. (3) The Board may, if it thinks fit, meet the whole or any portion of the expenses incurred in execution of work mentioned in sub-sections (1) and (2) of this section.
