1[125A . Penalty for filing false affidavit, etc.-- A candidate who himself or through his proposer, with intent to be elected in an election,--: (i) fails to furnish information relating to sub-section (1) of section 33 A; or (ii) gives false information which he knows or has reason to believe to be false; or (iii) conceals any information, in his nomination paper delivered under sub-section (1) of section 33 or in his affidavit which is required to be delivered under sub-section (2) of section 33 A, as the case may be, shall, notwithstanding anything contained in any other law for the time being in force, be punishable with imprisonment for a term which may extend to six months, or with fine, or with both] ______________________ 1. Whoever, for the purpose of causing any increase in payment or benefit under this Act, or for the purpose of causing any payment or benefit to be made where no payment or benefit is authorized by or under this Act, or for the purpose of avoiding any payment to be made by himself under this Act or enabling any other person to avoid any such payment, knowingly makes or causes to be made any false statement or false representation, shall be punishable with imprisonment for a term which may extend to 1[six months], or with fine not exceeding 2[two thousand] rupees, or with both: 3[Provided that where an insured person is convicted under this section, he shall not be entitled for any cash benefit under this Act for such period as may be prescribed by the Central Government.] _________________ 1. .....proved to be justified as being for the public good on the ground that such book, pamphlet, paper, slide, film, writing, drawing, painting, photograph, representation or figure is in the interest of science, literature, art, or learning or other objects of general concern; or (ii) which is kept or used bona fide for religious purposes; (b) any representation sculptured, engraved, painted or otherwise represented on or in-- (i) any ancient monument within the meaning of the Ancient Monument and Archaeological Sites and Remains Act, 1958 (24 of 1958); or (ii) any temple, or on any car used for the conveyance of idols, or kept or used for any religious purpose. (c) any film in respect of which the provisions of Part II of the Cinematograph Act, 1952 (37 of 1952), will be applicable.

.....Republic of India as follows:-- 1. Short title This Act may be called the Representation of the People (Amendment) Act, 2002. 2. Amendment of section 8 of Act 43 of 1951 In the Representation of the People Act, 1951, in section 8,-- (a) in sub-section (1),-- (i) in clause (k), after the word and figures "Act, 1971", the word"; or" shall be inserted; (ii) after clause (k), the following clauses shall be inserted, namely:-- "(l) the Commission of Sati (Prevention) Act, 1987 (3 of 1988); or (m) the Prevention of Corruption Act, 1988 (49 of 1988); or (n) the Prevention of Terrorism Act, 2002 (15 of 2002),"; (iii) for the portion beginning with the words "shall be disqualified" and ending with the words "such conviction", the following shall be substituted, namely:-- "shall be disqualified, where the convicted person is sentenced to-- (i) only fine, for a period of six years from the date of such conviction; (ii) imprisonment, from the date of such conviction and shall continue to be disqualified for a further period of six years since his release"; (b) in sub-section (2),-- (i) in clause (c), for the figures and word "1961; or", the figures "1961,".....

In the Representation of the People Act, 1951,-- (a) in section 26, sub-section (5) shall be omitted; (b) in section 78, sub-section (2) shall be omitted. Section 4 - Repeal and saving (1) The Representation of the People (Amendment) Ordinance, 2003(Ord. 5 of 2003) is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the Representation of the People Act, 1950(43 of 1950) and the Representation of the People Act, 1951(43 of 1951) as amended by the said Ordinance, shall be deemed to have been done or taken under the said Acts, as amended by this Act.

Amendment of Fourth Schedule to Act 43 of 1950 In the Fourth Schedule to the Representation of the People Act, 1950, for the heading "BIHAR" and the entries relating thereto, the following shall be substituted, namely:-- "BIHAR 1. Nagar Parishads. 2. Cantonment Boards. 3. Nagar Panchayats. 4. Zila Parishads. 5. Panchayat Samitis. 6. Nagar Nigams (Corporations). 7. Gram Panchayats.".
