THE CHHATTISGARH LOK SEWA GUARANTEE ACT, 2011 THE CHHATTISGARH LOK SEWA GUARANTEE ACT, 2011 [Act No. 23 of 2011] ( Published in the Chhattisgarh Rajpatra (Asadharan) dated 12-10-2011 Pages 566(6-9).) [12th October, 2011] PREAMBLE An Act to provide for the delivery of certain public services to citizens by the State Government, local bodies, public authorities or agencies within the stipulated time, and to fix the liabilities of persons responsible for delivery of such services in the event of default and for matters connected therewith or incidental thereto. Be it enacted by the Chhattisgarh Legislature in the Sixty-second Year of the Republic of India, as follows:-- Section 1 - Short title, extent, commencement and application (1) This Act may be called the Chhattisgarh Lok Sewa Guarantee Act, 2011. (2) It extends to the whole State of Chhattisgarh. (3) It shall come into force on such date as the State Government may, by notification in the official Gazette, appoint. Coinage Act, 2011, (Central) Section 9

Title: Power to Certain Persons to Cut, Diminished or Defaced Coins

(1) Where any coin which has been minted and issued by or under the authority of the Government is tendered to any person authorised by it to act under this section, and such person has reason to believe that the coin-- (a) has been diminished in weight so as to be more than such per cent, below standard weight as provided in section 5; or (b) has been defaced, he shall, by himself or through another person, cut or break the coin. (2) A person cutting or breaking coin under the provisions of clause (a) of sub-section (1) shall receive and pay for the coin at its face value. (3) A person cutting or breaking coin under the provisions of clause (b) of sub-section (1) shall observe the following procedure, namely:-- (a) if such person has reason to believe, that the coin has been fraudulently defaced, he shall return the pieces to the person tendering the coin, who shall bear the loss caused by such cutting or breaking; (b) if such person has reason to believe, that the coin has not been fraudulently defaced, he shall receive and pay for the coin at its face value.

Title: Power to Certain Persons to Cut Counterfeit Coins

Where any coin minted or issued by or under the authority of the Government is tendered to any person authorised by the Government under section 9 and such person has reason to believe that the coin is counterfeit, he shall by himself or through another person cut or break the coin, and the tenderer shall bear the loss caused by such cutting or breaking.

Title: Validation of Exemption Given to a Person by Tour Operator Having Contract Carriage Permit for Inter

.....the powers conferred by subsection (1) of section 93 of the Finance Act, 1994(32 of 1994), granting exemption from the whole of service tax leviable under section 66 of that Act to any person by a tour operator having a contract carriage permit for inter-State or intra-State transportation of passengers, excluding tourism, conducted tour, charter or hire service, shall be deemed to have, and deemed always to have, for all purposes, validly come into force on and from the 1st day of April, 2000, at all material times. (2) Refund shall be made of all such service tax which has been collected but which would not have been so collected as if the notification referred to in sub-section (1) had been in force at all material times. (3) Notwithstanding anything contained in the Finance Act, 1994()32 of 1994, an application for the claim of refund of service tax shall be made within six months from the date on which the Finance Bill, 2011 receives the assent of the President. Explanation.--For the removal of doubts, it is hereby declared that the provisions of section 11B of the Central Excise Act, 1944(1of 1944), shall be applicable in case of refunds under this section.

After section 19 of the principal Act, the following section shall be inserted, namely:- "19A. Transplantation of Human Organs (Amendment) Act, 2011, (Central) Section 17

Title: Amendment of Section 19

In section 19 of the principal Act,- (a) after clause (f), the following clause shall be inserted, namely:- "(g) abets in the preparation or submission of false documents including giving false affidavits to establish that the donor is making the donation of the human organs, as a near relative or by reason of affection or attachment towards the recipient."; (b) for the words "two years but which may extend to seven years and shall be liable to fine which shall not be less than ten thousand rupees but may extend to twenty thousand rupees", the words "five years but which may extend to ten years and shall be liable to fine which shall not be less than twenty lakh rupees but may extend to one crore rupees" shall be substituted; (c) the proviso shall be omitted.
