BOMBAY CITY (INAMI AND SPECIAL TENURES) ABOLITION AND MAHARASHTRA LAND REVENUE CODE (AMENDMENT) ACT, 1969, (Maharashtra) Section 4

Title: Abolition of inami tenure and special tenures; extinguishment of superior holder's rights; and liability to pay land revenue

.....be liable to the State Government for the payment of land revenue equal to the amount of cess, rent or assessment which is payable in respect thereof immediately before the appointed day to the superior holder, or as the case may be, to the State Government under the terms of the tenure, or (ii) shall be held free from payment of land revenue, if no such cess, rent or assessment is payable in respect thereof immediately before the appointed day. NOTES The intention of the section indicates that it is meant for "extending the benefit to the public trusts even in the cases where the property is let out and not necessarily used physically, therefore the trustees are entitled to claim exemption certificates under section 4(2) in respect of the lands in question". .....may extend to twenty five rupees for every day during which failure continues after conviction for the first such failure State Government may make rules. SECTION 19: RULES (1) The State Government may, subject to the condition of previous publication, make rules for the purposes of carrying out the provisions of this Act. THE SREEPADAM LANDS ENFRANCHISEMENT ACT, 1969 Act 20 of 1969 THE SREEPADAM LANDS ENFRANCHISEMENT ACT, 1969 An Act to provide for the enfranchisement of Sreepadam lands on payment of compensation and for matters connected therewith. Preamble . " WHEREAS it is expedient to provide for the enfranchisement of Sreepadam lands on payment of compensation and for matters connected therewith; Be it enacted in the Nineteenth Year of the Republic of India as follows:" 1 Short title, and commencement . " (1) This Act may be called the Sreepadam Lands Enfranchisement Act, 1969. (2) It shall come into farce on such date as the Government m ay, by notification in the Gazette, appoint. 2. Definitions . "In this Act, unless the context otherwise requires, " (a) "appointed day" means the day on which this Act comes into force; (b) "basic-tax" means the tax imposed under the provisions of the Kerala Land Tax Act, 1961 (13 of 1961) ; (c) "financial year" means the year commencing on the 1st day of April; (d) "holding" means any parcel or parcels of Sreepadam lands held by a landholder; (e) "kuthakapattom" means a lease of Sreepadam lands of trees on such lands or of trees on such lands.....

MAHARASHTRA (VIDARBHA REGION) AGRICULTURAL DEBTORS RELIEF ACT, 1969 MAHARASHTRA (VIDARBHA REGION) AGRICULTURAL DEBTORS RELIEF ACT, 1969 18th April 1969 An Act to provide for the relief of certain agricultural debtors in the Vidarbha region of the State of Maharashtra. WHEREAS, it is expedient to provide for the relief of certain agricultural debtors in the Vidarbha region of the State of Maharashtra ; It is hereby enacted in the Twentieth Year of the Republic of India as follows :- CHAPTER 01: PRELIMINARY SECTION 01: SHORT TITLE, EXTEND AND COMMENCEMENT (1) This Act may be called the Maharashtra (Vidarbha Region) Agricultural Debtors Relief Act, 1969. (2) It extends to the Vidarbha region of the State of Maharashtra. (3) It shall be deemed to have come into force on the 7th day of March 1969. SECTION 02: DEFINITIONS In this Act, unless the context otherwise requires, (1) "award" means an award made under sub-section (4) of sec. 6 or section 7 or 23 or as confirmed or modified by the Court in appeal; (2) "Code" means the Maharashtra Land Revenue Code, 1966 ; (3) "Court" means the court of the Civil Judge(Senior Division) having ordinary jurisdiction in the area.....

Title: Method of Awarding Compensation for Abolition Etc., of Rights of Other Persons in Property

.....within the prescribed period, to the Collector for compensation. (2) The Collector shall, after holding inquiry in the prescribed manner, make an award determining the compensation in the manner and according to the method provided for in sub-section (1) of section 23 and section 24 of the Land Acquisition Act, 1894. (3) Nothing in this section shall entitle any person to compensation on the ground that any land which was wholly or partially exempt from payment of land revenue, or was held in limitation of the right of the State Government to assess it to land revenue at all or beyond a specific limit has been under the provisions of this Act made subject to the payment of full assessment in accordance with provisions of this Act. NOTES Application for compensation.-There is nothing in rule 12, which prescribes limitations for an application for compensation under section 14 of the Act. (1) Save as otherwise expressly provided in this Act any person aggrieved by any order passed under this Act or the rules made thereunder, may prefer an appeal within thirty days from the date of the order before the Collector, and if the original order is passed by the Collector, before the Board of Revenue.
