.....Be it enacted by Parliament in the Forty-third Year of the Republic of India as follows :--- SECTION 01: SHORT TITLE AND COMMENCEMENT (1) This Act may be called The Finance Act. 1992. (2) Save as otherwise provided in this Act Sections 2-to108,116and117[except sections61.109. sub-section (1) of section 110andsections 112and113shall be deemed to have come into force on the 1st day of April, 1992. SECTION 02: INCOME-TAX (1) Subject to the provisions of sub-sections (2) and (3). for the assessment year commencing on the 1st day of April. 1992, income-tax shall be charged at the rates specified in Part I of the First Schedule and such tax as reduced by the rebate of income- tax calculated under section 88 of the Income-tax Act. 1961(hereinafter referred to as the Income-tax Act) shall be increased. (a) in the cases to which Paragraphs A. B. C and D of that Part apply, by a surcharge for purposes of the union: and (b) in the cases to which Paragraphs A, B. E of that Part applies, by a surcharge, calculated in each case in the manner provided therein. .....Assembly having received the assent of the Governor on 27th day of March, 1992, is hereby published for general information:" THE SIKKIM EXCISE ACT, 1992 (ACT NO. 2 OF 1992) An Act to provide for the manufacture, possession, sale, transport, import and export of alcoholic liquor and imposition of duty of excise therein and for matters connected therewith and incidental thereto. Be it enacted by the Legislature of Sikkim in the Forty-third Year of the Republic of India as follows :- CHAPTER I Preliminary Short title, extent and commencement. 1. (1) This. Act may be called the Sikkim Excise Act, 1992. (2) It extends to the whole of Sikkim. (3) It shall come into force on such date as the Government may, by notification, appoint, Definitions 2. (2) Any reference in this Act to any other enactment or any provision thereof, shall, in relation to an area in which such enactment or such provision is not in force, be construed as a reference to the corresponding law or the relevant provision of the corresponding law, if any, in force in that area. SECTION 03: CERTAIN PROHIBITIONS IN RELATION TO INFANT MILK SUBSTITUTES, FEEDING BOTTLES AND INFANT FOODS NO PERSON SHALL- (a) advertise, or take part in the publication of any advertisement, for the distribution, sale or supply of infant milk substitutes7feeding bottles or infant foods or (b) give an impression or create a belief in any manner that feeding of8infant milk substitutes and infant foods are equivalent to, or better than, mother's milk; or 9(c) take part in the promotion of infant milk substitutes, feeding bottles or infant foods. .....person subject to this Act deserts or attempts to desert the service shall, on conviction by a Force Court (a) if he commits the offence when on active duty or when under orders for active duty, be liable to suffer death or such less punishment as is in this Act mentioned; and (b) if he commits the offence under any other circumstances, be liable to suffer imprisonment for a term which may extend to seven years or such less punishment as is in this Act mentioned. (2) Any person subject to this Act who knowingly harbours any such deserter shall, on conviction by a Force Court, be liable to suffer imprisonment for a term which may extend to seven years or such less punishment as is in the Act mentioned. (3) Any reason subject to this Act who, being cognizant of any desertion or attempt at desertion of a person subject to this Act, does not forthwith give notice to his own or some other superior officer, or take any steps in his power to cause such pension to be apprehended, shall, on conviction by a Force Court, be liable to suffer imprisonment for a term which may extend to two years or such less punishment as is in this Act mentioned.
