An Act to make provisions for the establishment of a Municipal Corporation in Gangtok and for matters connected therewith [12tll October, 1975] WHEREAS,. it is expedient to make provisions for the establishment of a Municipal Corporation at Gangtok and matters connected therewith. It is hereby enacted: as follows; CHAPTER1 Preliminary Short title, extent and commencement. (Subs, by sec. 3 of G. Nt. C. (Amd.) Act No. .5 of 1'976. (w.e. f. 9.12.76)) (i) This Act may be called the. Gangtok Municipality, Corporation Act, 1975. (2) It extends and applies to the town of Gangtok; but the State Government, may- by notification extend all or any of the provisions of, this Act to areas outside the town of Gangtok. Section 30 - Central Relief Fund 1[(1)] In order to carry out the purposes of this Act, a fund called the Central Relief Fund shall be formed. Title: Dissolution of the Board

(1) The Central Government may, by notification in the Official Gazette and for reasons to be specified therein, direct that the Board shall be dissolved from such date and for such period as may be specified in the notification : Provided that before issuing any such notification, the Central Government shall give a reasonable opportunity to the Board to make representations against the proposed dissolution and shall consider the representations, if any, of the Board. (2) When the Board is dissolved under the provisions of sub-section (1), (a) all members notwithstanding that their term of office has not expired, shall, from the date of dissolution, vacate their offices as such members; (b) all powers and duties of the Board shall, during the period of dissolution, be exercised and performed by such person or persons as the Central Government may appoint in this behalf; (c) all funds and other properties vested in the. Board shall, during the period of dissolution, vest in the Central Government; and (d) as soon as the period of dissolution expires the Board shall be reconstituted in accordance with the provisions of this Act.

At any time after the expiration of three months from the date on which a beggar is detained in a relief centre, if the officer-in-charge of such relief centre is satisfied from the conduct of such beggar in such centre during the period of his detention that there is a probability that such person will abstain from begging, he may recommend to the Government his unconditional release and the Government may order the release of such person unconditionally and thereupon the term for which such person had been ordered to be detained in a relief centre shall be deemed to have expired.
