The Orissa Tenancy Act, 1913 Complete Act

.....Puri and Balasore in the State of Orissa, except any area or part of an area which is constituted as a Municipality under the Bengal Municipal Act, 1884 (Bengal Act III of 1884), and which is specified in this behalf by notification issued by the State Government. Section 2 - Repeal The enactments specified in Schedule I are hereby repealed in the area to which this Act extends. Section 3 - Definitions (1) In this Act, unless there is something repugnant in the subject or context (1) "agricultural year" means the year commencing on the first day of Baisakh of the Oriya year; Provided that the first agricultural year shall be deemed to commence on the first day of Baisakh following the date of the commencement of this Act; (2) "bazyaftidar" means a person holding lands the title to hold which upon special terms was declared invalid by the Cuttack Land Revenue Regulation, 1805 (XII of 1805), the Bengal Land Revenue Assessment (Resumed Lands) Regulation, 1819 (II of 1819) or the Bengal Revenue-free Lands Regulation, 1825 (XIV of 1825) and which have been assessed, in the course of a settlement of land-revenue, at a rent fixed for the term of that settlement; and.....

OFFICIAL TRUSTEES ACT, 1913 OFFICIAL TRUSTEES ACT, 1913 AN ACT TO CONSOLIDATE AND AMEND THE LAW CONSTITUTING THE OFFICE OF OFFICIAL TRUSTEE. IT IS HEREBY ENACTED AS FOLLOWS:- PART -I PRELIMINARY SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Official Trustees Act, 1913. (2) It extends to the whole of India. (3) It shall come into force on such date as the Central Government, by notification in the Official Gazette may direct. SECTION 02: INTERPRETATION CLAUSE In this Act, unless there is anything repugnant in the subject or context,- (1) "Government" or "the Government" means, in relation to a Stale, the State Government and, in relation to a Union territory, the Central Government. The Redemption of Mortgages (Punjab) Act, 1913 Complete Act

.....shall mean prescribed by rules made under this Act. Application of certain sections of Punjab Tenancy Act. 3. Subject to the provisions of this Act and the rules thereunder, the provisions of sections 79, 85, 86, 87, 89, 90, 91, 92 and 101, of the Punjab Tenancy Act, 1887, shall, so far as may be, apply to all proceedings of a Collector under this Act. Petition of redemption 4. The mortgagor or other person entitled to institute a suit for redemption may, at any time after the principal money becomes payable and before a suit for redemption is barred, present a petition to the Collector applying for an order directing that his mortgage be redeemed, and where the mortgage is with possession that he be put in possession of the mortgaged property. The petition shall be duly verified in the manner prescribed by law for the verification of plaints, and shalll state the sum which the petitioner declares to the best of his belief to be due under the mortgage. Official Trustees Act, 1913 Section 10

Title: Power of High Court to a Appoint Official Trustee to Be Trustee of Property

(1) If any property is subject to a trust other than a trust which the Official Trustee is prohibited from accepting under the provisions of this Act, and there is no trustee within the local limits of the ordinary or extraordinary original civil jurisdiction of the High Court willing or capable to act in the trust, the High Court may on application make an order for the appointment of the Official Trustee by that name with his consent to be the trustee of such property. (2) Upon such order such property shall vest in the Official Trustee and shall be held by him upon the same trusts as the same was held previously to such order, and the previous trustee or trustees (if any) shall be exempt from the liability as trustees of such property save in respect of acts done before the date of such order.
