.....Procuring entity for Projects. " (1) Every public agency designated by the Board to implement a Project shall be a procuring entity under the Tender Act (Tamil Nadu Act 43 of 1998): Provided that the Board may, for any class of Project as may be prescribed in the Rules, be the procuring entity under the Tender Act. (2) No procurement under this Act shall be made by the procuring entity except by tender, following the provisions contained in the Tender Act. (3) The tender documents shall be in the form and manner as may be prescribed in the regulations: Provided that for any class of Project as may be prescribed in the regulations, the procuring entity shall submit the tender documents for prior approval of the Board. (4) The procuring entity shall, in respect of Projects identified by the Board, intimate the name and address of the tenderer whose tender has been accepted, to the Board and shall also obtain its approval on the concession agreement to be entered into with such tenderer. 19. .....every person employed by the existing Institute immediately before the appointed day shall hold office or service in the Institute by the same tenure, at the same remuneration and upon the same terms and conditions and with the same rights and privileges as to pension, leave, gratuity, provident fund and other matters as he would have held the same if this Act had not been passed, and shall continue to do so unless and until his employment is terminated or until such tenure, remuneration and terms and conditions are duly altered by the Statutes: Provided that if the alteration so made is not acceptable to such employee, his employment may be terminated by the Institute in accordance with the terms of the contract with the employee or, if no provision is made therein in this behalf, on payment to him by the Institute a compensation equivalent to three months' remuneration in the case of permanent employees and one month's remuneration in the case of other employees.

Act No.1/2012 TAMIL NADU CO-OPERATIVE SOCIETIES (APPOINTMENT OF SPECIAL OFFICERS) AMENDMENT ACT, 2012 (Received the Assent of the Governor of Tamil Nadu on February 9, 2012 " Published in Tamil Nadu Government Gazette, Extraordinary, Part IV, Section 2, Iss. No.32, page 62, dated February 9, 2012). An Act further to amend the. Tamil Nadu Co-operative Societies (Appointment of Special Officers) Act, 1976. Be it enacted by the Legislative Assembly of the State of Tamil Nadu in the Sixty-third Year of the Republic of India as follows:" 1. Short title and commencement. " (1) This Act may be called the Tamil Nadu Co-operative Societies (Appointment of Special Officers) Amendment Act, 2012. (2) It shall come into force at once. 2. Amendment of Section 4." In Section 4 of the Tamil Nadu Co-operative Societies (Appointment of Special Officers) Act, 1976 (President's Act 25 of 1976), in sub-section (1), for the expression "thirty five years and eight months", the expression "thirty six years and two months" shall be substituted. Title: Transfer of Service of Existing Employees

Subject to the provisions of this Act, every person who is employed in the National Institute of Mental Health and Neuro-Sciences, Bangalore, immediately before the commencement of this Act, shall, on and from such commencement, become an employee of the Institute and shall hold his office or service therein by the same tenure, at the same remuneration and upon the same terms and conditions and with the same rights and privileges as to pension, leave, gratuity, provident fund and other matters as he would have held the same on the date of commencement of this Act if this Act had not been passed, and shall continue to do so unless and until his employment is terminated or until such tenure, remuneration and terms and conditions are duly altered by regulations: Provided that the tenure, remuneration and terms and conditions of service of any such person shall not be altered to his disadvantage without the previous approval of the Central Government.

Title: Term of Office of and Vacancies Among Members

.....of a member shall be five years from the date of his nomination or election. (2) The term of office of a member elected under clause (l) of sub-section (1) of section 5 shall come to an end as soon as he becomes a Minister or Minister of State or Deputy Minister or the Speaker or the Deputy Speaker of the House of the People or the Deputy Chairman of the Council of States or ceases to be a member of the House from which he was elected. (3) The term of office of an ex officio member shall continue so long as he holds the office by virtue of which he is such a member. (4) The term of office of a member nominated or elected to fill a casual vacancy shall continue for the remainder of the term of the member in whose place he is nominated or elected. (5) An outgoing member other than a member elected under clause (l) of sub-section (1) of section 5 shall continue in office until another person is nominated as a member in his place or for a period of three months, whichever is earlier: Provided that the Central Government shall nominate a member in place of an outgoing member within the said period of three months. Title: Terms of Office Of, Vacancies Among, and Allowances Payable to Members of Executive Council

(1) The term of office of every member of the Executive Council shall be for a period of three years from the date of his nomination: Provided that the term of office of an ex officio member shall continue so long as he holds the office by virtue of which he is a member. (2) The term of office of a member nominated to fill a casual vacancy shall be for the remainder of the term of the member in whose place he has been nominated. (3) Notwithstanding anything contained in this section, an out-going member shall, unless the Central Government otherwise directs, continue in office until another person is nominated as a member in his place or until the expiry of one year, whichever is earlier. (4) The members of the Executive Council, other than ex officio members, shall be paid such travelling and other allowances as may be provided by the Statutes.
