West Bengal Local Bodies (Electoral Offences and Miscellaneous Provisions) Act, 1952 Complete Act

.....Bengal Municipal Act, 1932, or 66. Words and figures subs. for the words and figures "in rule 4 of Part II of Schedule II to the Calcutta Municipal Act, 1951," by W.B. Act 26 of 1984, w.e.f. 25.6.1984. [in rule 4 of Part II of Schedule III to the Calcutta Municipal Corporation Act, 1980,] at or in connection with an election, he shall be punishable with fine which may extend to two hundred and fifty rupees. Section 10 Breaches of official duty in connection with election (1) If any person to whom this section applies is without reasonable cause guilty of any act or omission in breach of his official duty, he shall be punishable with fine which may extend to five hundred rupees. (2) No suit or other legal proceedings shall lie against any such person for damages in respect of any such act or omission as aforesaid. (3) The persons to whom this section applies are the Registering Authorities for preparation or revision of electoral rolls, returning officers (which expression shall mean the Chairman of the Commissioners of municipalities in reference to elections under the Bengal Municipal Act, 1932), presiding officers, polling officers and any other person appointed to perform.....

.....a necessity arises appoint any indigenous Khasi male adult of good moral character, who is a resident and is not employed under any Organisation, to act as Acting Chief when a vacancy occurs. (2) An Acting Syiem or Acting Chief will remain in Office until appointment of a new Syiem or until further order of the Executive Committee whichever is earlier. (3) Whenever there is a change of incumbent on account of Sub-Section (1) above, there shall be a proper taking and handing over charge of the Office properties, duly recorded in writing between the predecessor and the successor incumbents in the presence of some Lyngdoh or Sirdar as witnesses. Any deliberate or wilful violation of this provision shall be treated to be an act of criminal breach of trust and the incumbent is liable to be proceeded with accordingly. 9. Appointment and affirmation of the Deputy Syiem : - (1) When a vacancy occurs in the Office of the Deputy Syiem, a person who fulfill the qualification prescribed under Section 3 of this Act shall on the recommendation of the Syiem and Dorbar be forwarded to Executive Committee for approval.
