THE SIKKIM COURT FEES AND STAMPS ON DOCUMENTS (AMENDMENT) ACT, 2002 GOVERNMENT OF SIKKIM LAW DEPARTMENT GANGTOK No. 7/LD/2002 Dated the 10th April, 2002. NOTIFICATION The following Act of the Sikkim Legislative Assembly having received the assent of the Governor on 30th day of March, 2002 is hereby published for general information :- THE SIKKIM COURT FEES AND STAMPS ON DOCUMENTS (AMENDMENT) ACT, 2002 (ACT NO. 7 OF 2002) An Act t o amend the Sikkim Court Fees and Stamps on Documents Rules, 1928. Be it enacted by the Legislature of Sikkim in the Fifty " third Year of the Republic of India as follows :- Short title and commencement. 1. (1) this Act may be called the Sikkim Court Fees and Stamps on Document (Amendment) Act, 2002. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the Sikkim Court Fees and Stamps on Documents Rules, 1928, in Schedule (A), in serial number (1), against the "plaints in Civil Suits or Civil Appeals", under the column " Value of Stamp chargeable", for the words ˜annas two in a rupee", the words and figure "6(six) percentum", shall be substituted. Title: Amendment of Section 17a of Act 28 of 1954

In the High Court Judges (Salaries and Conditions of Service) Act, 1954, in section 17A, in sub-section (1),-- (i) for the words "sixty per cent. of the pension admissible to him", the words "fifty per cent. of his Salary" shall be substituted; (ii) for the words and thereafter at the rate of half of the family pension so admissible", the words "and thereafter at the rate of thirty per cent. of his salary" shall be substituted; (iii) before the Explanation, the following proviso shall be inserted, namely:-- "Provided that in no case the amount of family pension calculated under this sub-section shall exceed the pension payable to the Judge under this Act.".

Title: Amendment of Section 16a of Act 41 of 1958

In the Supreme Court Judges (Salaries and Conditions of Service) Act 1958, in section 16A, in sub-section (1),-- (i) in clause (a),-- (A) for the words "family pension calculated at the rate of sixty per cent. of the pension admissible to him", the words "family pension calculated at the rate of fifty per cent. of his salary" shall be substituted; (B) for the words "and thereafter at the rate of half of the family pension so admissible", the words "and thereafter at the rate of thirty per cent. of his salary" shall be substituted; (ii) in clause (b), for the words "family pension shall be thirty per cent. of the pension admissible", the words "family pension shall be thirty per cent. of his salary" shall be substituted; (iii) before the Explanation, the following proviso shall be inserted, namely:-- "Provided that in no case the amount of family pension calculated under this sub-section shall exceed the pension payable to the Judge under this Act.".

.....tapes or sound tracks from out of which sound or images can be reproduced, shall be admissible in the trial of such person for an offence under this Act or rules made thereunder. (2) A police officer shall, before recording any confession made by a person under sub-section (1), explain to such person in writing that he is not bound to make a confession and that if he does so, it may be used against him: Provided that where such person prefers to remain silent, the police officer shall not compel or induce him to make any confession. (3) The confession shall be recorded in an atmosphere free from threat or inducement and shall be in the same language in which the person makes it. (4) The person from whom a confession has been recorded under sub-section (1), shall be produced before the Court of a Chief Metropolitan Magistrate or the Court of a Chief Judicial Magistrate along with the original statement of confession, written or recorded on mechanical or electronic device within forty-eight hours. (5) The Chief Metropolitan Magistrate or the Chief Judicial Magistrate, shall, record the statement, if any, made by the person so produced and get his signature or thumb.....
